When you need it

You are an NRI or OCI cardholder who has inherited a house, a plot, a share in a property or other property in Punjab or Chandigarh from a parent or other relative, and a bank, the Sub-Registrar or a buyer wants a sworn statement of how you inherited it, from whom, who else shares in it, and what your own status is. This is that declaration, with space for the Will, probate or succession certificate if there is one.

This declaration does not prove that you own the property, and it does not replace a Will, a probate, a succession certificate, a mutation or a family settlement. Not for buying a property — use the NRI/OCI Declaration for Property Purchase (FEMA). Not for authorising someone in India to act for you — use the NRI Power of Attorney.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A nominal fixed duty applies to a general affidavit in Punjab and Chandigarh; confirm the current figure at the counter or with the notary.

Registration

Not separately registrable — handed to the bank or buyer, or filed with the Sub-Registrar as a supporting paper, rather than lodged on its own.

Notarisation

Sworn before a Notary Public or an Oath Commissioner, with the deponent appearing in person with photo identification. Where it is sworn outside India, some banks and Sub-Registrars also expect apostille or consular attestation — confirm before the appointment.

Witnesses

Not required by law.
