When you need it

You were an Indian citizen from Punjab or Chandigarh, have taken the citizenship of another country, and need a sworn declaration for (a) your application for an Overseas Citizen of India (OCI) card, (b) surrendering your Indian passport, or (c) both. You choose which one in the questions, and the document prints only the parts that apply.

The Indian Embassy, High Commission or Consulate that handles your case, and the OCI application process itself, may prescribe their own forms, photographs, fees and attachments. This document does not replace those. It is the sworn statement that goes with them, in the words the current rules ask a person in your position to confirm. Not for property purchase (see the NRI/OCI Declaration for Property Purchase (FEMA)), and not for proving who you are for a marriage (see the NRI Marriage Registration Affidavit).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

If sworn in India, an affidavit carries a small fixed stamp duty under Article 4, Schedule I-A (Punjab) or the corresponding Chandigarh entry; confirm the current figure at the counter. If sworn abroad, the notary or the Indian Mission will say whether any stamp is needed there; a paper that first reaches India afterwards may need stamping within the time the law allows.

Registration

Not registrable. It is filed with the OCI application and with the Indian Embassy, High Commission or Consulate handling the passport, not lodged on its own.

Notarisation

Sworn before a Notary Public or, where the Mission accepts it, an Indian Consul or Vice-Consul. Confirm the Mission's own format and attestation requirements before you swear; some prescribe their own proforma.

Witnesses

Not required by law. Some Missions ask for identification and photographs at the time of swearing; confirm before the appointment.

A. My foreign citizenship

A1. That I was a citizen of India and held the Indian passport whose number is stated above.

A2. That I acquired the citizenship of Canada on 2 April 2026, voluntarily, and that I hold a Canada passport number AB123456.

B. Declaration in support of my application for an Overseas Citizen of India (OCI) card

B1. That before I took foreign citizenship I was a citizen of India, in that: I was born in Jalandhar, Punjab, and held an Indian passport from 2004 until I took Canadian citizenship.

B2. That I am applying for an OCI card on the basis of that former Indian citizenship, and that the particulars in my application and in this declaration are the same.
