When you need it

You are an NRI or OCI cardholder buying residential or commercial property in Punjab or Chandigarh, and want (or the Sub-Registrar/bank asks for) a sworn declaration confirming your status, that the property is not agricultural land, plantation property or a farmhouse — which FEMA does not permit an NRI or OCI cardholder to acquire — and that payment is being made through permitted banking channels. Not for buying agricultural land, plantation property or a farmhouse — the Foreign Exchange Management Act, 1999 and the rules made under it do not permit an NRI or OCI cardholder to acquire these categories by purchase, and this declaration cannot be used to get around that restriction.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Chargeable under Article 4, Schedule I-A (Punjab) or the corresponding Chandigarh entry — a nominal fixed duty for a general affidavit; confirm the current figure at the counter.

Registration

Not separately registrable — filed as a supporting annexure with the sale deed presented for registration, or with the bank handling the purchase payment, rather than lodged on its own.

Notarisation

Sworn before a Notary Public or an Oath Commissioner, with the deponent appearing in person with photo identification. Where sworn outside India, some Sub-Registrars or banks additionally expect apostille or consular attestation — confirm before the appointment.

Witnesses

Not required by law.
