When you need it

Choose now who decides about your treatment if you cannot. After a stroke, a fall or a serious illness, hospitals ask someone to sign for consent. This names that person, says what they may decide, and lets the doctors see it in writing.

Indian law has no single statute for a medical power of attorney; hospitals usually look to the nearest relative or the person you have named, so a clear signed and witnessed paper helps, but acceptance is up to the hospital and the doctors. Keep a copy with the person named, your family doctor, and the hospital you use. Not for a decision to refuse life-prolonging treatment at the end of life: use the Living Will (Advance Medical Directive). Not for your bank account: use the Power of Attorney for Bank. Not for property: that needs a separate power.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A power of attorney is chargeable to stamp duty under the Stamp Act as it applies in Punjab and Chandigarh. A power limited to medical decisions gives no power over property, which may keep the duty low, but the figure is not printed here. VERIFY the stamp paper value at the e-stamp vendor or Sub-Registrar.

Registration

Not required, because the power gives no power over immovable property.

Notarisation

Notarisation is advised, since hospitals and banks accept a notarised power more readily. If the Principal signs outside India, consular attestation or an apostille may be needed.

Witnesses

Two adult witnesses who are not the Agent and who take nothing from the Principal. Record their names and addresses.
