When you need it

You are letting out a car, jeep or other vehicle you own, for a fixed number of months at a monthly rent, or taking one on that basis: for example a firm taking a car for its staff, or a person taking a relative's vehicle for a year. The Agreement records the vehicle, the rent and deposit, who drives, who pays for fuel, servicing, tolls and challans, what happens after an accident, and how the vehicle is returned.

Check first that the vehicle may lawfully be let this way. A vehicle registered for private use cannot ordinarily be hired out to the public for a fee; whether a monthly lease to one named user or firm is allowed, and what registration or permit it needs, depends on the Motor Vehicles Act and the permit rules. This Agreement makes the Owner state what the registration allows, but it cannot make an unlawful use lawful. Not for a vehicle attached to a taxi operator, a school or a transporter (use Commercial Vehicle Attachment Agreement). Not for a sale on instalments (use Car / Bike Sale Agreement). Not for a short one-day trip hire, which is a rental company's own booking.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A monthly lease or rental of a movable vehicle is a contract for hire, not a lease of land or buildings. The stamp on it, if any, is the fixed amount for an agreement; we do not state a figure here because Punjab and Chandigarh revise theirs from time to time. Check the current amount on the official e-stamping portal or with the stamp vendor before you buy the paper. Where the Hirer is a company, its own policy may ask for stamp paper anyway.

Registration

Not registrable under the Registration Act, 1908: it concerns a movable vehicle, not land or buildings. Any change to the vehicle’s registration record is made separately, at the Registering Authority.

Notarisation

Not required by law. A notary only records that the signatories appeared and signed, which makes it harder to deny a signature later. Carry original photo ID.

Witnesses

Two witnesses are sensible, each writing full name, address and ID reference beside the signature. A witness is an adult who is not a party to the document.

VEHICLE RENTAL OR MONTHLY LEASE AGREEMENT

This Agreement is made at Chandigarh on 2 April 2026 between:

Harjinder Singh, of House No. 21, Sector 15, Chandigarh (the "Owner"); and

Kaur Traders, of SCO 45, Sector 34-A, Chandigarh (the "Hirer").

  1. 1. THE VEHICLE AND ITS USE

1.1 The Owner lets and the Hirer takes on hire the vehicle: Maruti Suzuki Swift VXi, white, registration number PB10 AB 1234 , chassis number MA3EWDE1S00123456, engine number K12MN1234567 (the "Vehicle").

1.2 The Vehicle is let for: private use only, by the Hirer and the people the Hirer names. The Hirer shall not use it for any other purpose, shall not sub-let it, and shall not carry passengers for a fee or goods for hire unless the registration and permit allow it.

1.3 The Owner states that he or she is the registered owner, that the RC, the insurance and the pollution certificate are valid on the start date, and that no one else has a claim on the Vehicle that would stop the Hirer using it, except any financer’s hypothecation shown on the RC, of which the Owner has told the Hirer.

  1. 2. TERM, RENT AND DEPOSIT

2.1 The hire runs from 1 April 2026 to 2 April 2026.

2.2 The Hirer shall pay rent of ₹25,000 (Rupees Twenty Five Thousand only) a month, by the 5th of each month, by bank transfer or by cheque, and the Owner shall give a receipt.

2.3 The Hirer has paid a security deposit of ₹50,000 (Rupees Fifty Thousand only). It carries no interest. The Owner shall return it within fifteen days after the Vehicle is returned, less any sum due for unpaid rent, damage beyond fair wear and tear, or challans and tolls left unpaid.

  1. 3. DRIVING, RUNNING COSTS AND KILOMETRES

3.1 Driver: The Hirer, or a person the Hirer names who holds a valid licence for this class of vehicle. No one may drive the Vehicle without a valid driving licence for its class, or while impaired by alcohol or drugs.

3.3 Kilometres: 2,000 km a month; Rs 8 for every extra km.

3.4 Challans, fines and tolls incurred while the Vehicle is with the Hirer belong to the Hirer, who shall pay them promptly. If the Owner has to pay one, the Hirer shall repay it on demand.

  1. 4. INSURANCE AND ACCIDENTS

4.1 The Owner shall keep the Vehicle’s motor insurance in force throughout the hire. The Hirer shall not do anything that would make the policy void.

4.2 After any accident, theft or damage, the Hirer shall at once inform the Owner and, where the law requires, the police and the insurer, and shall not admit liability or settle a claim without the Owner’s consent.

4.3 If damage is not covered by the insurer, or the insurer deducts an excess, the Hirer shall bear that part where the damage came from the Hirer’s or the driver’s fault. Damage from a defect already in the Vehicle is the Owner’s.
