When you need it

You own a vehicle and someone else will be driving it: a relative, a friend, an employee or a driver taking it on a long trip or to another State. This letter, signed by the owner, says who may drive it, from when to when, and for what purpose, so the driver can show it to the police or at a toll or check post if asked.

It is a useful paper to carry, but it is not a legal requirement in every case, and it does not replace the driving licence, the RC, the insurance or the pollution certificate, which the driver should carry anyway. It gives the driver no right to sell, pledge, hire out or keep the vehicle. Not for giving someone the power to sell the vehicle or deal with the transport office for you (use Power of Attorney for Vehicle Sale and RTO). Not for a monthly hire (use Vehicle Rental or Monthly Lease Agreement). Not for a vehicle run for hire or reward, which needs the right permit.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty is stated for this letter: it creates or transfers no right in property and is only the owner’s written permission. Keep it on plain paper or the owner’s letterhead.

Registration

Not registrable under the Registration Act, 1908: it concerns a movable vehicle, not land or buildings. Any change to the vehicle’s registration record is made separately, at the Registering Authority.

Notarisation

Not required. For a long trip or a trip to another State, a notarised copy is sometimes asked for at a check post; it costs little and makes the letter easier to accept. Carry original photo ID.

Witnesses

No witness is needed; the owner signs alone.
