Why you need it

When you need it

Living abroad, can't visit PB/CH property often? Need someone to check it, pay bills, keep it repaired, stop anyone moving in. This engages a provider to inspect on schedule with photos, send reports, pay outgoings from a float, arrange repairs to a limit, report trespass same-day. If let, rent goes to you; TDS is checked.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No power to sign for the Owner, no interest transferred — Article 5, Schedule I-A, Stamp Act 1899 (PB/CH), a small fixed sum. S.18's three months needs EVERY party abroad — the Provider signs in India, so stamp before the Provider signs.

Registration

Not registrable: s.17, Registration Act, 1908 needs a Rs 100+ property interest created; this creates none. Optional under s.18, pointless.

Notarisation

Not required for validity — but attest an abroad signature for proof.

Witnesses

Not required by law — witness the Owner's signature abroad and the Provider's in India, each where made.
