When you need it

A brand, shop or business in Punjab or Chandigarh pays a content creator, or gives free products, for posts, reels, stories or videos about its products, and wants it written down. The agreement sets out exactly what will be posted and when, what the brand must approve first, the fee or the free product, the disclosure that the post is paid or gifted, how long the brand may reuse the content (including as an ad), whether the creator may promote a competitor, and what happens if the creator does not post.

The disclosure clause matters: a paid or gifted post that does not clearly say so can break the consumer-protection rules on endorsements and the advertising standards body's guidelines. The agreement requires clear disclosure, and the creator must follow the disclosure rules in force when posting. Not for hiring a person to run a business's social pages every month (use the Digital Marketing Agency Agreement). Not for a one-off design job (use the Freelancer Agreement).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Stamp duty depends on what the paper does and on the Schedule to the Indian Stamp Act, 1899 as applied in Punjab and in Chandigarh. An agreement of this kind is usually charged as an agreement not otherwise provided for, at a modest fixed figure, but the figure is not stated here: confirm it on the official e-stamping portal or with the Sub-Registrar before buying the stamp. If a clause makes the paper in substance something else (a transfer of property, a lease, a power of attorney, a guarantee), it is charged as that. An under-stamped paper cannot be used as evidence until the deficit and penalty are paid.

Registration

Not compulsorily registrable unless it creates or transfers a right in immovable property (section 17, Registration Act, 1908); this paper is not meant to. Registration is optional if the parties want it.

Notarisation

Not required by law, and not a substitute for stamping. A notary only records that the signatories appeared and signed, which makes it harder to deny a signature later. Carry original photo ID.

Witnesses

Not required by law, but two adult witnesses who are not parties, each writing name, address and ID reference beside the signature, make a later denial harder.

  1. 1. THE CONTENT

1.1 The Influencer shall create and post the following content: 2 Instagram reels (30 to 60 seconds) and 4 stories showing the Brand's festive collection, each tagging the Brand's account.

1.2 All the content shall be posted by 1 April 2026 and shall stay up, unhidden and undeleted, for at least 90 days from posting.

1.3 The Influencer shall send each draft to the Brand at least 3 days before posting. The Brand may ask for changes to correct a factual error, a safety or legal problem, or a departure from the agreed content, and the Influencer shall make them. The Brand shall not require a change to the Influencer's honest opinion. The Influencer shall not post a draft the Brand has not approved.

  1. 2. DISCLOSURE AND TRUTHFUL CLAIMS

2.1 Every post shall say clearly, in the post itself and in the form the platform and the law require, that it is a paid promotion, an advertisement or a gifted product, using plain words such as "ad", "paid partnership" or "gifted". The Influencer shall follow the endorsement and advertising-disclosure rules and guidelines in force on the day of posting.

2.2 The Influencer shall say only what the Influencer honestly believes after using or examining the product, shall make no claim about the product that the Brand has not supplied or cannot support, and shall make no health, medical or income claim at all unless the Brand has given the Influencer written, supportable wording. The Brand shall supply accurate product information and shall not ask for a false claim.

  1. 3. WHAT THE INFLUENCER RECEIVES

3.1 The Influencer receives: a cash fee only.

3.2 Cash fee: ₹25,000 (Rupees Twenty Five Thousand only), before GST, paid within 15 days of the last post going live, after an invoice. GST is added at the rate in force if the Influencer is registered. Where the law requires the Brand to deduct tax at source, the Brand shall deduct it and give the Influencer the certificate for it.

3.3 Free products: Two phulkari dupattas and one jacket, worth about Rs 9,000 in all. The Influencer may keep them. The Influencer is responsible for any tax on the value of the products as the law requires.

3.4 If the Influencer does not post the agreed content by the date in clause 1.2, or removes it early, the Brand may withhold the fee for the part not delivered or removed, and the Influencer shall return the value of any product for the part not delivered, unless the delay is caused by the Brand or by an event beyond the Influencer's control.
