When you need it

When an owner or executant is too sick, frail or disabled to travel to the Sub-Registrar's office to sign and admit a deed, and you want the Sub-Registrar to attend at the house. The Registration Act, 1908 allows the registering officer, on special cause shown, to attend at the residence of a person who wants to present a document, and a doctor's certificate is the usual proof.

The officer decides; the fee, the date and whether the visit is allowed are for the office. This is your own request with the document, the stamp and the doctor's certificate ready. Not for a person who is merely busy or abroad (use a registered power of attorney, or see the office's remote options).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty is payable on the request. The document being registered must be duly stamped as usual before the visit, and the office may ask for a fee for attendance at the residence.

Registration

The request is not registered. The document itself is registered at the house, within the four months allowed for presentation, with the usual photographs, fingerprints and witnesses.

Notarisation

Not required, unless the office asks for an affidavit with it.

Witnesses

Not needed for the request. The deed itself needs its usual witnesses on the day.
