When you need it

When a deed was signed and stamped but was not presented for registration within the four months the Registration Act, 1908 allows, because of an unavoidable cause. The Registrar may allow it to be presented late, up to four months more, on payment of a fine; after that the deed cannot be registered by this route.

This is your own application, to be filed with the deed, setting out the dates and why you were late. Not for a deed that is also short of stamp duty (settle the duty first; see Application for Adjudication of Stamp Duty), and not a substitute for the indemnity some offices ask for where the delay is long.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty is payable on the application. The deed must already be duly stamped; if duty is short, it must be made good, with any penalty, before the Registrar will take the deed.

Registration

The application is not registered. If the Registrar allows it, the deed is registered on payment of the fine, with all the executants appearing as for any registration.

Notarisation

Not required, unless the office asks for an affidavit with it.

Witnesses

Not required.

  1. 4. The delay was not intended and did not come from any wish to avoid duty or registration. The deed is duly stamped.

I declare that the facts stated above are true to my knowledge.
