When you need it

When you are not sure what stamp duty a property document should carry, or whether it is chargeable under one article or another, and want the Collector's written decision before paying or before relying on the document. The Indian Stamp Act, 1899 lets a person holding an instrument, signed or not, bring it to the Collector to say what duty it needs; the Collector's certificate then settles the question for that document.

Typical doubts: an agreement under which possession passes, a family transfer, a document partly for money and partly for something else. This is your own application with the instrument or draft enclosed. Not for a document that has been registered and is being called undervalued (use Reply to Under-Valuation Notice (Section 47-A)).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

The application itself carries no stamp duty, but the Act asks for a fee on adjudication; ask the Collector's office what it is and how to pay it. The instrument is stamped after the Collector decides, to the amount the certificate states.

Registration

Notarisation

Not required, unless the office asks for an affidavit with it.
