REPLY TO THE NOTICE OF UNDER-VALUATION
Before The Collector who sent the notice
In the matter of notice Case no. 45/2026 dated 1 April 2026.
Place: Chandigarh. Date: 3 April 2026. Date fixed for hearing: 2 April 2026.
Reply by Harpreet Singh, of House 12, Sector 35-A, Chandigarh, who is the buyer in the deed.
Filed through Adv. Ravinder Kaur, Advocate, X.
RESPECTFULLY SHOWETH:
- 1. The deed is: Sale deed dated 10 September 2026, registered as no. 2345 at the Sub-Registrar, Mohali. It covers Second floor of House 1234, Phase 3B1, Mohali. The price stated in it is ₹75,00,000 (Rupees Seventy Five Lakh only).
- 2. By the notice, the property is said to be worth ₹95,00,000 (Rupees Ninety Five Lakh only). The notice demands ₹25,000 (Rupees Twenty Five Thousand only) as extra duty, penalty or interest. I deny that the property was undervalued.
- 3. My objections to the notice are: The notice applies the rate for new construction, but the building is 25 years old and in poor repair; the price was paid by bank transfer and is the true price.
- 4. My case on the value is: The value in the deed, supported by a registered valuer's report and two sales of similar floors in the same lane in the last year.
- 5. I ask for a fair hearing and for copies of any report, rate list or other material the notice relies on, so that I can answer it.
PRAYER
It is prayed that the Collector be pleased to (a) hear the buyer before deciding; (b) hold that the price stated in the deed is the market value of the property, or fix the value at the figure proved; (c) drop the demand for extra duty, penalty and interest, or reduce it to what is due on that value; and (d) take no step to recover the demand until the matter is decided.
