Subject: Claim for damage and dilapidations at Office 304, Third Floor, Tower B, Elante Business Park, Industrial Area Phase 1, Chandigarh 160002 under Commercial Lease Deed dated 1 April 2026
Dear Sir or Madam,
- 1. BACKGROUND
1.1 You occupied Office 304, Third Floor, Tower B, Elante Business Park, Industrial Area Phase 1, Chandigarh 160002 (the "Premises") under Commercial Lease Deed dated 1 April 2026 (the "Lease"). You vacated, or the Lease ended, on 1 April 2026.
1.2 I inspected the Premises on 2 April 2026. This letter sets out the damage and dilapidations I found beyond fair wear and tear, the cost of putting them right, and how that cost is set against your security deposit.
- 2. THE CLAIM
2.1 The items claimed are: 1. Broken tiles in the pantry, replacement and labour, Rs 18,000. 2. Holes and marks in walls, repainting, Rs 24,000. 3. Missing access cards (4), Rs 2,000..
2.2 The total of the items claimed is ₹44,000 (Rupees Forty Four Thousand only).
2.3 I have not included anything that is fair wear and tear, meaning the ordinary ageing of the Premises through proper use over the time of the Lease.
2.4 The cost of each item is my reasonable and actual cost, or the cost shown by the quotations I have obtained. If I have not yet incurred an item, the amount is a reasonable estimate and I shall adjust it to the actual cost when the work is done.
- 3. YOUR SECURITY DEPOSIT
3.1 I hold a security deposit of ₹5,10,000 (Rupees Five Lakh Ten Thousand only) under the Lease.
3.2 I set off ₹44,000 (Rupees Forty Four Thousand only) of the deposit against the claim in clause 2.
3.3 After that set-off the balance of ₹4,66,000 (Rupees Four Lakh Sixty Six Thousand only) is payable by the Landlord to the Tenant as a refund of the deposit, and shall be paid within 15 days of the date of this letter. A dispute over one item does not delay payment of the undisputed part (clause 4.3).
- 4. EVIDENCE AND YOUR RESPONSE
4.1 The evidence for this claim is: Dated photographs, the inspection report, the contractors’ quotations and the handover memo of 15 November 2026. You may inspect it, and take copies, at a reasonable time on notice to me.
4.2 If you disagree with any item, please tell me in writing within 15 days of the date of this letter, naming the item and giving your reasons. If I do not hear from you in that time, I shall treat the claim as accepted.
4.3 The undisputed part of the deposit balance shall be paid as in clause 3.3 without waiting for the disputed items to be settled.
- 5. RIGHTS RESERVED
5.1 This claim is made without prejudice to my other rights under the Lease and the law. If a further item comes to light which could not reasonably have been found at the inspection, I may claim it by a further letter.
