When you need it

A commercial tenant that pays rent above the limit set by the income-tax law has to deduct tax at source from the rent, deposit that tax with the government, file a quarterly statement, and give the landlord a TDS certificate (Form 16A). The landlord needs that certificate, or at least the tax shown against its PAN in its tax statement, to claim credit for the tax in its own return.

Tenants are often late, or the PAN is entered wrongly, and the landlord is left unable to claim the credit. This letter is a polite, firm written request from the landlord to the tenant for the certificate. It identifies the lease and the period, gives the landlord's PAN so the tenant can check it against its records, states the rent and tax figures the landlord's records show (if the landlord wishes), asks for the certificate within a stated number of days, and asks the tenant, if it did not deduct tax, to say so and explain why. Use it when rent was paid net of tax and the certificate has not come, or when you want to ask for it at the end of each quarter or year. Not for: a dispute about whether tax should have been deducted at all, a tenant's deduction of the wrong amount (that is a dispute to settle with a chartered accountant first), or a notice of default under the lease. The letter does not state the rate of tax or the limits at which tax is deducted; these change and should be confirmed with a chartered accountant.

It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. Subject: Request for the TDS certificate (Form 16A) for the financial year 2025-26, for the rent of the premises at Shop No. 3, Ground Floor, SCO 11, Sector 8-C, Chandigarh, Chandigarh

Dear Sir or Madam,

  1. 1. The Tenant occupies the premises known as Shop No. 3, Ground Floor, SCO 11, Sector 8-C, Chandigarh, situated at Chandigarh, in the State of Punjab (the "Premises"), under a Lease Deed dated 2 January 2026 between the Landlord and the Tenant for a term of 9 years commencing 1 February 2026 (the "Lease"), and pays the Landlord rent for it.
  1. 2. Where tax is deducted at source from rent, the income-tax law requires the person who deducted it to deposit it with the government, to file the statement for each quarter, and to give the person from whose rent it was deducted a TDS certificate in Form 16A. The Landlord needs that certificate, and the tax appearing against its PAN, to claim credit for the tax in its own return.
  1. 3. The Landlord asks the Tenant to give it the TDS certificate in Form 16A for the rent paid for the Premises for all four quarters of that financial year, of the financial year 2025-26.
  1. 4. The quarters are: July to September 2025 and October to December 2025.
  1. 5. The Landlord's records show that rent of ₹14,40,000 (Rupees Fourteen Lakh Forty Thousand only) was paid for that period.
  1. 6. The Tenant has told the Landlord that it deducted tax of ₹1,44,000 (Rupees One Lakh Forty Four Thousand only) for that period. Please make sure the certificate shows that figure, or tell us why it differs.
  1. 7. The Landlord's PAN is ABCDE1234F. Please check that this is the PAN on the Tenant's records and in the statements filed, because the tax will not appear in the Landlord's tax statement if a wrong PAN was used.
  1. 8. Please send the certificate within 15 days of receiving this letter. If tax was deducted but not yet deposited, or the statement has not yet been filed, please deposit it and file the statement and tell the Landlord when this is done.
  1. 9. Please send the certificate to: accounts@example.com.
  1. 10. If the Tenant did not deduct tax on the rent for any period, because it believes it was not required to, please say so in writing within the same time and give the reason, so that the Landlord can account for the rent correctly.
  1. 11. This letter is a request. It does not change the Lease, and the Landlord reserves all its rights under the Lease and in law.
