When you need it

The Authority, the adjudicating officer or the appellate tribunal has ordered a builder to refund your money, pay interest, hand over possession or put something right, the time allowed has passed, and the builder has done nothing. This is your own application to the Authority to enforce that order: it identifies the order, records what has not been done, says whether an appeal or stay is pending, and asks that the order be executed.

The mode of enforcement, the fee and any prescribed form for execution differ and change, so ask the Authority's registry before filing. Execution applications are usually filed through an advocate. Attach a certified copy of the order. Not for the original complaint — use the RERA complaint for Punjab (Form 'M') or the RERA Complaint: Chandigarh. Not for an order of a civil court or a consumer forum.

APPLICATION FOR EXECUTION OF THE ORDER DATED 2 April 2026

The applicant respectfully states:

1. On 2 April 2026, the Authority passed an order in Complaint No. 123 of 2025. By that order the respondent was directed as follows:

Refund Rs 35,00,000 with interest as stated in the order within 60 days.

2. The order allowed the following time for compliance: 60 days from the date of the order. That time has expired.

3. The respondent has not complied with the order. The position is:

Nothing has been paid. The amount due under the order, with interest worked out to this date, is Rs 41,25,000. Reminders were sent on 3 June 2026 and 18 July 2026.

4. No appeal has been filed against the order, and no stay is in force.

5. The applicant therefore asks that the order be enforced by the means the Real Estate (Regulation and Development) Act, 2016 and the rules made under it provide, including, where the order is for payment, recovery of the amount due as the law permits.

6. The following papers are enclosed:

1. Certified copy of the order dated 12 March 2026
2. Copies of reminder letters
3. Statement of the amount due

PRAYER

It is therefore prayed that the Authority may be pleased to:
(a) execute the order dated 2 April 2026 passed in Complaint No. 123 of 2025 against the respondent, by the means the law provides; and
(b) pass any other order the Authority considers just in the circumstances.
