When you need it

A builder is advertising, taking bookings or selling units in a project that does not show a RERA registration number, or whose number you cannot find on the regulator's website, and you have paid or been asked to pay. This is your own complaint to the Authority under section 31: it says what you booked, what you paid, how you checked that the project is not registered, and asks the Authority to stop the sales, return your money, or both, and to act against the builder.

Some small projects are exempt from registration, so keep proof of how you checked and ask the Authority's office whether the project needs registration. For a Chandigarh project, confirm which authority hears it. Complaints are usually filed through an advocate. Not for a registered project that is simply late — use the RERA Complaint: Chandigarh, or the Punjab Complaint in Form 'M'. Not for enforcing an order already passed — use the Execution Application for a RERA Order.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

The complaint is paid for by the fee the Authority's rules prescribe, not by stamp duty on this paper; an affidavit filed with it may need its own stamp or e-stamp as the Authority requires. Confirm both at the Authority's office before filing.

Registration

Not registrable: section 17 of the Registration Act, 1908 does not reach a paper of this kind.

Notarisation

The complaint is signed and verified by the complainant. The supporting affidavit, if the Authority asks for one, is sworn before a notary or oath commissioner.

Witnesses

Not required. The complainant, or the advocate on the complainant's instructions, signs.

COMPLAINT AGAINST AN UNREGISTERED PROJECT, UNDER SECTION 31 OF THE REAL ESTATE (REGULATION AND DEVELOPMENT) ACT, 2016

The complainant respectfully states:

  1. 1. The respondent is promoting a project called Green Park Heights at Sector 82, S.A.S. Nagar (Mohali). The complainant booked or agreed to buy a unit in it, as follows:

On 14 January 2026 the complainant booked a 3-bedroom flat for Rs 55,00,000 and signed a booking form. The seller issued a receipt.

The complainant has paid ₹5,00,000 (Rupees Five Lakh only) in all.

  1. 2. The project is not registered with the Authority. The complainant has checked this as follows:

On 3 March 2026 the complainant searched the Authority's website by project name and promoter name and found no registration. The seller was asked for a registration number and gave none.

  1. 3. The Act does not allow a promoter to advertise, market, book, sell or offer for sale units in a project that requires registration unless it is registered with the Authority. As far as the complainant knows, this project is of a size and kind that requires registration, and the respondent has not shown otherwise.
  1. 4. The complainant asks the Authority to direct the respondent to stop advertising, marketing, booking and selling units in the project until it is registered, and to take against the respondent the action the Act allows for carrying on without registration.

The complainant also asks for: X

  1. 5. Other proceedings on the same matter: None.
  1. 6. The complainant relies on the following documents, copies of which are filed with this complaint:
  1. 1. Booking form dated 14 January 2026
  2. 2. Payment receipt
  3. 3. Brochure and advertisement
  4. 4. Screenshot of the search on the Authority's website
  1. 7. The fee prescribed for this complaint is paid as the Authority's rules require. Particulars: X.

PRAYER

It is therefore prayed that the Authority may be pleased to:
(a) direct the respondent to stop advertising, marketing, booking and selling units in the project until it is registered, as the Real Estate (Regulation and Development) Act, 2016 and the rules allow;
(b) take against the respondent the action the Act allows for a project carried on without registration; and
(c) pass any other order the Authority considers just in the circumstances.
