When you need it

You are a promoter applying to register a real estate project with the Real Estate Regulatory Authority and need the promoter's declaration that goes with the application. This is your own declaration: it states your title to the land or your authority to develop it, any charge on the land, the date by which you will complete the project, the separate bank account for the project money, and that the accounts will be audited and the statements filed as the Act requires.

The Authority prescribes the application, the forms and the documents for registration, and they change. Ask the Authority's office what it needs and attach this declaration only if it is accepted in this form, or use it as the base for the Authority's own format. A company signs through a person authorised by a board resolution. Not for a buyer's complaint — use the RERA Complaint: Chandigarh or the Punjab Complaint in Form 'M'. Not for a project already registered that needs an extension.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

If the Authority wants the declaration sworn as an affidavit, it goes on stamp paper or e-stamp as the Authority requires; ask the Authority's office what it accepts and the current duty for an affidavit in Punjab or in Chandigarh. A declaration on plain paper attracts no stamp duty of its own.

Registration

Not registrable: section 17 of the Registration Act, 1908 does not reach it.

Notarisation

Sworn before a notary or oath commissioner if the Authority asks for an affidavit; otherwise signed and verified by the promoter.

Witnesses

Not required.
