When you need it

You bought a flat, plot or shop in a Chandigarh project and the promoter has delayed possession, refused a refund, changed what was promised or left defects unrepaired. This is your own complaint to the real estate regulator under section 31 of the RERA Act: numbered paragraphs with the facts, the relief you ask for, the documents you rely on and a prayer, with a verification at the end.

The Authority and the form it expects for a Chandigarh project can differ from Punjab's and can change, so check with the Authority's office or website before filing, and ask whether a prescribed form and a supporting affidavit are also required. Complaints are usually filed through an advocate. Not for a project in Punjab — use the Punjab Complaint in Form 'M'. Not for a project that was never registered — use the Complaint against an Unregistered Project. Not for enforcing an order already passed — use the Execution Application for a RERA Order.

What follows is written for Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

The complaint is paid for by the fee the Authority's rules prescribe, not by stamp duty on this paper; an affidavit filed with it may need its own stamp or e-stamp as the Authority requires. Confirm both at the Authority's office before filing.

Registration

Not registrable: section 17 of the Registration Act, 1908 does not reach a paper of this kind.

Notarisation

The complaint is signed and verified by the complainant. The supporting affidavit, if the Authority asks for one, is sworn before a notary or oath commissioner.

Witnesses

Not required. The complainant, or the advocate on the complainant's instructions, signs.
