When you need it

A residential allottee has found a structural defect, or a defect in workmanship, quality or a service the promoter/builder was obliged to provide under the Agreement for Sale/Builder-Buyer Agreement, and wants to put the promoter on formal, dated notice to rectify it. Section 14(3) of the Real Estate (Regulation and Development) Act, 2016 makes it the promoter's duty to rectify such a defect without further charge, within thirty days of it being brought to notice, PROVIDED it is brought to notice within five years from the date possession was handed over.

Beyond that five-year window, section 14(3) itself no longer applies, whatever other remedy may separately exist. Use this at the initial handover, when a fresh unit is inspected before or as possession is taken, or at any later point within the five years — a structural crack, a leak, or a lift that was working at handover but fails eighteen months later is squarely what this provision is for.   3. 3. Common-area lift in Tower C frequently non-functional, affecting access to the unit.
  1. 4. Supporting evidence: Dated photographs and a video of the seepage, enclosed as Annexure A.
  1. 5. Prior complaint(s) already made: X
  1. 6. You are called upon to rectify the above defect(s), without any charge to me/us, within 30 days of receipt of this notice, consistently with section 14(3) of the Real Estate (Regulation and Development) Act, 2016.
  1. 7. I/we reserve the right to claim compensation under the Real Estate (Regulation and Development) Act, 2016 if the defects are not rectified within the period stated above
  1. 8. Failing rectification within that period, I/we shall be constrained to approach the Real Estate Regulatory Authority and/or the appropriate consumer forum/court, at S.A.S. Nagar (Mohali), for compensation and such other relief as may be available, at your cost and consequence.
