When you need it

A business, shop, factory or institution in Punjab or Chandigarh (the Principal) wants a contractor or staffing agency (the Contractor) to supply workers — office staff, helpers, drivers, technicians, housekeeping — while the workers stay on the Contractor's payroll. It fixes how many workers, for what work, at what rate, how the Contractor pays them and their statutory dues, and what the Principal does if the Contractor fails.

A Contractor who supplies contract labour on the scale the law sets generally needs a licence, and a Principal that engages such a contractor needs to be registered, under the contract labour law in force. This agreement asks for the Contractor's licence details and records them; it does not check them. Ask for the papers and keep a copy. MANPOWER SUPPLY AGREEMENT

This Agreement is made at S.A.S. Nagar (Mohali) on 1 April 2026 between:

Sunrise Packaging Industries, of Plot 22, Phase 7, Industrial Area, S.A.S. Nagar (Mohali) 160055, acting through Gurmeet Singh, Partner (the Principal); and

Shakti Manpower Services, of SCO 112, Sector 34-A, Chandigarh 160022, acting through Harjit Kaur, Proprietor (the Contractor).

1. THE WORK. The Contractor will supply workers to the Principal as follows: 12 machine helpers and 3 packing supervisors for the packing line, day shift, Monday to Saturday. The workers will work at Plot 22, Phase 7, Industrial Area, S.A.S. Nagar (Mohali) 160055.

2. CONTRACTOR'S LICENCE. The Contractor states that it holds the following licence or registration, and that it is valid: Licence no. as issued by the labour department, valid until 31 March 2028 Its other registration details are: PAN ABCDE1234F; GSTIN 03ABCDE1234F1Z5; PF and ESI numbers as registered. The Contractor will keep it valid for the whole term and will tell the Principal at once if it lapses or is cancelled.

3. THE CONTRACTOR IS THE EMPLOYER. The workers are employed by the Contractor and not by the Principal. The Contractor alone hires them, gives them appointment letters, pays them, and disciplines them, and the Principal may give day-to-day instructions on the work only. No contract of employment arises between the Principal and any worker by reason of this Agreement.

4. WAGES AND DUES. The Contractor will pay each worker at least the wages fixed by law, on or before the date the law requires, by bank transfer, and will give each worker a pay slip. The Contractor will pay all provident fund, state insurance, bonus, gratuity, leave and other dues for its workers on time, and will register them under the schemes that apply.

5. PROOF OF PAYMENT. Along with each monthly invoice, the Contractor will give the Principal proof that wages and contributions for the month have been paid, including the bank transfer record and the provident fund and state insurance challans. The Principal need not pay an invoice for any month for which proof has not been given.

6. THE CHARGE. The Principal will pay the Contractor a fixed monthly charge for each worker, being Rs 19,500 per worker per month, or a service charge of 8 percent of the wages and contributions. GST is added where it applies. The Contractor will send an invoice each month, and the Principal will pay within 15 days of receiving a correct invoice with the proof under clause 5.

7. IF THE CONTRACTOR FAILS TO PAY. If the Contractor fails to pay a worker's wages or other dues, and the law makes the Principal liable for them, the Principal may pay the amount to the worker directly and recover it from the Contractor, by deducting it from any sum due to the Contractor or otherwise.
