Why you need it

When you need it

Transfer or settle property for someone else while reserving a lifetime right of possession, residence or income for the settlor or another life tenant — separate the present transfer from the reserved life interest. TPA 1882 has no single settlement-deed rule; it's characterised by what it transfers. As a voluntary transfer without consideration, sections 122–123 (gift, registration, two-witness attestation) apply; a settlor-at-will revocation clause is barred by section 126. Allocate maintenance/taxes, state whether the remainder vests now subject to the life estate, and when possession shifts. Punjab authority/Chandigarh sector property needs the local file's acceptance.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab/Chandigarh: first settle what this instrument IS. Section 2(24)(b), Indian Stamp Act 1899 makes a disposition distributing the settlor's property among family, or for a dependant, a SETTLEMENT — the gift article (33) excludes it; Article 58 charges it. Punjab: no published settlement line — get the Sub-Registrar's assessment or Collector adjudication (section 31) first. If charged as a gift instead: 7.25% total (5% duty + 1% cess + 1% PIDB + 0.25% SIDF), though Order S.O.28/C.A.2/1899/S.9/2014 remits duty in whole on a lifetime transfer to children/grandchildren/siblings; registration fee 1% (min Rs 50, max Rs 2,00,000), no remission. Chandigarh: the table has a family-settlement line at 2% (calculator agrees); it charges a gift at 5% and exempts blood-relation transfers — which line applies to a life-interest settlement isn't established, so ask first. Registration fee 1%, capped Rs 10,000, plus Rs 20 pasting, payable even if duty is exempt. Stamp at signing (section 17); understamped instruments are inadmissible until cured (section 35).

Registration

Punjab/Chandigarh: compulsory where the instrument presently creates or transfers immovable rights (section 17, Registration Act 1908); if it operates as a gift, section 123, Transfer of Property Act 1882 also applies.

Notarisation

Punjab and Chandigarh: Notarisation does not substitute for registration.

Witnesses

Punjab/Chandigarh: two witnesses attest, since the instrument operates as a voluntary gift/settlement of immovable property under section 123.
