When you need it

For an account holder whose bank passbook or fixed deposit (FD) receipt has been lost, or whose account has become dormant from long non-use, where the branch asks for the holder's sworn affidavit before issuing a duplicate, paying out or reactivating the account. You choose which of the three cases applies in the questions, and where the bank wants an indemnity the holder's undertaking is added in the same document.

You choose Punjab or Chandigarh in the questions as well. Not for lost title deeds, certificates or property papers (use the Lost Document Affidavit), not for stopping a cheque (use the Stop Payment Letter to Bank), and not for a claim after the account holder has died (use the Indemnity Bond for a Deceased Account Holder's Bank Claim). The bank may insist on its own form or wording; ask the branch first.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, non-judicial stamp paper, commonly Rs 10, e-stamped via SHCIL (shcilestamp.com) or bought from a licensed vendor. Chandigarh: Article 4, Schedule I to the Indian Stamp Act, 1899 as extended to the Union Territory, the same nominal denomination, from SHCIL or the Treasury, Sector 17. Confirm the denomination with the vendor on the day of purchase. Where the Bank also wants a separate indemnity bond, that bond is a different instrument chargeable on its own stamp paper; the Bank will say what value it needs.

Registration

Not a registrable instrument. The affidavit is handed to the bank branch with its own application and identity papers and kept in the bank's records. There is no Sub-Registrar step.

Notarisation

Sworn or affirmed before a Notary Public (Notaries Act, 1952) or an Executive Magistrate/Oath Commissioner appointed for Punjab or for the Union Territory of Chandigarh, who verifies the identity of each person signing and signs, stamps and dates the affidavit before it is filed.

Witnesses

None required by law beyond the notarial attestation. Some banks ask for a guarantor or an introducer who already banks with them for a lost FD receipt; that is the bank's own requirement, not the law's.
