Why you need it

When you need it

An adult wanting to formally change their name — on marriage, on religious conversion, to correct a spelling that has carried across documents, for personal preference, or for astrological or numerological reasons — needs a sworn affidavit before most authorities will update a record. This affidavit alone is what banks, employers, schools and universities commonly accept to update their own records in the new name. It is also Step 1 before the separate Gazette Name Change Application in this library, which some authorities — government service records, some professional registrations, a passport re-issue in certain categories — additionally require. Not for a minor's name: a minor's change is affirmed by a natural guardian in different words, which this template does not provide. Punjab and Chandigarh: sworn before a Notary Public or an Oath Commissioner, then produced directly at the counter that needs the update, or annexed to the Gazette application.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab — non-judicial stamp paper, commonly of Rs 10 denomination, bought from a licensed stamp vendor or e-stamped through SHCIL (shcilestamp.com), the sole e-stamping agency for Punjab. Chandigarh: Article 4, Schedule I to the Indian Stamp Act, 1899 as extended to the Union Territory, the same nominal denomination, e-stamped via SHCIL or bought at the Treasury, Sector 17. Buy the stamp paper before the notary appointment, not after — a notary will not swear an affidavit onto paper bought afterwards.

Registration

Not a registrable instrument. Section 17 of the Registration Act, 1908 reaches instruments affecting immovable property, and this affidavit affects neither, so there is no Sub-Registrar step. It is complete on notarisation and is then produced directly before whichever bank, employer, university or department needs the name updated, or annexed to the Gazette Name Change Application for publication.

Notarisation

Sworn before a Notary Public appointed under the Notaries Act, 1952 and the Notaries Rules, 1956, or affirmed before an Oath Commissioner appointed by the District & Sessions Judge of the district. Both are equally acceptable to the authorities this affidavit is typically produced before. A few banks additionally accept their own branch manager's attestation for a small internal update, but that does not substitute for notarisation where the affidavit is meant for UIDAI, PAN or Gazette use. The deponent signs in the notary's or Oath Commissioner's presence, not before.

Witnesses

None required by law. A notarised or sworn affidavit is authenticated by the notary's or Oath Commissioner's own seal and register entry, not by attesting witnesses. Some notaries nonetheless ask for an identifying witness where the deponent is not personally known to them — carry a second photo ID in case one is asked for.

AFFIDAVIT FOR CHANGE OF NAME

  1. That my name as recorded in my existing documents and records is Harpreet Singh.
  1. That I have given up the name Harpreet Singh and have adopted, and shall hereafter be known by, the name Harpreet Singh Sethi for all purposes.
  1. That the reason for this change of name is marriage.

Further detail: Married on 14 February 2026, marriage registered at Chandigarh vide Certificate No. MR/2026/1187.

  1. That Harpreet Singh and Harpreet Singh Sethi are one and the same person, that this change of name is made voluntarily and out of my own free will, and that it is not made for any fraudulent purpose and not to evade any legal obligation or to defraud or cause loss to any person.

What this document is for

An adult in Punjab or Chandigarh who wants to formally change their name — on marriage, on religious conversion, to correct a spelling that has drifted across documents, or simply by personal preference — swears this before a notary or oath commissioner so that banks, employers, schools and universities have something sworn to update their own records against. It is a sworn declaration of the change, not an application to any government office.

It exists because most authorities will not update a name on their own say-so — they want a notarised affidavit first, and this is that affidavit, built for the two places this document serves. It is commonly also Step 1 before a separate Gazette Name Change Application, which some authorities — government service records, some professional registrations, a passport re-issue in certain categories — additionally insist on.

Before you use this — what this affidavit does, and what it does not

This affidavit is not for a minor’s name change — a minor’s change is affirmed by a natural guardian in different words, which this document does not provide, and the deponent has to appear in person, never through an agent or a power of attorney holder. It also does not, by itself, update Aadhaar or PAN records; UIDAI and the PAN authorities each run their own separate correction process with their own accepted supporting documents, and this affidavit is typically only one piece of what that process asks for.

Stamp paper and registration

Stamp paper needed

Yes

Typical stamp duty — Punjab

Rs 10, non-judicial stamp paper under Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab — bought from a licensed stamp vendor or e-stamped through SHCIL, the state’s sole e-stamping agency. Some tehsil or bank counters ask for a higher denomination by local practice, so confirm at the vendor or SHCIL counter before buying, and buy it before the notary appointment, not after.

Typical stamp duty — Chandigarh

Rs 10, the same nominal denomination under Article 4, Schedule I to the Indian Stamp Act, 1899 as extended to the Union Territory — e-stamped through SHCIL, or bought at the Treasury, Sector 17.

Registration at the Sub-Registrar

No Not registrable — section 17 of the Registration Act, 1908 reaches instruments affecting immovable property, and a name-change affidavit affects neither. It is complete on notarisation and then produced directly wherever the name update is actually needed, or annexed to a Gazette application.

Notary or witnesses

Sworn before a Notary Public or an Oath Commissioner — the deponent must appear in person, never through an agent or a power of attorney holder, and signs in the notary’s or oath commissioner’s presence, not before. No attesting witnesses are required by law, though some notaries ask for an identifying witness if the deponent is not personally known to them.

What you will need before you start

  • Your current legal name exactly as it appears in your existing documents, and the new name you have adopted
  • Your relationship detail (son of, daughter of, or wife of) and that person's name, your age, and your address
  • Your Aadhaar number, used only to identify you in this affidavit
  • The reason for the change, and any short factual detail worth recording — a marriage date, or the record a spelling correction is based on
  • A list of exactly which documents and records — Aadhaar, PAN, bank accounts, university records and the like — this affidavit will be used to update
  • A second photo ID to carry along, in case the notary asks for an identifying witness

Common mistakes

  • Assuming this affidavit automatically updates Aadhaar, PAN or other government database entries — each runs its own separate correction procedure with its own accepted documents.
  • Using it for a minor’s name change, which needs a natural guardian’s affidavit in different words, sworn by the guardian rather than the child.
  • Buying the stamp paper after the notary appointment rather than before — a notary will not swear an affidavit onto paper purchased afterwards.

Questions people ask before using this document

How much stamp duty does this affidavit need in Punjab or Chandigarh?

Rs 10 in both places, on non-judicial stamp paper under Article 4 of the applicable stamp schedule — bought from a licensed vendor or e-stamped through SHCIL in Punjab, or through SHCIL or at the Treasury, Sector 17, in Chandigarh. Some counters ask for a higher denomination by local practice, so it is worth confirming before you buy, and buy it before your notary appointment rather than after.

Does this affidavit automatically update my Aadhaar or PAN?

No. UIDAI and the PAN authorities each run their own separate name-correction process with their own list of accepted supporting documents, and this affidavit is not a substitute for either — it is commonly one of the supporting papers in that process, not the whole of it.

Do I need to publish this in the Gazette as well, or does the affidavit alone work?

It depends on who you are showing it to. This affidavit alone is what most banks, employers, schools and universities accept to update their own records. Some authorities — government service records, certain professional registrations, a passport re-issue in some categories — separately insist on Gazette publication as well, for which this affidavit is commonly Step 1.

Can I use this affidavit to change my child’s name?

No. This document is for an adult changing their own name and requires the deponent to appear in person. A minor’s name change is affirmed by a natural guardian, in different words, which this template does not provide.

How old can this affidavit be before an office stops accepting it?

There is no statutory expiry, but in practice banks, employers and other authorities commonly hesitate over one that is several months old. If an update has been pending for a while, swearing a fresh affidavit is usually simpler than arguing that an older one should still be accepted.
