When you need it

For a person applying for a Police Clearance Certificate, or a police verification, for a job or for a visa or immigration application — where the police, the employer or the consulate asks for a sworn declaration that no criminal case has been registered against the applicant, with the places the applicant has lived and the purpose of the clearance. In Punjab it is filed with the Punjab Police (through a Saanjh Kendra or the district police office) or the office that asked for it; in Chandigarh with the Chandigarh Police or the office that asked for it.

This is the applicant's sworn statement. It is not the clearance: the police, or for some visas the passport authority, issue that after their own check. Not for a general character or good-conduct statement for a licence or tenancy — use the Self-Declaration / Character Affidavit. Not for the police verification of a tenant or a paying guest — use the Tenant and Paying Guest Police Verification Report. Not for the employer's verification form for a new employee — use the Employee Police Verification Form.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, non-judicial stamp paper, commonly Rs 10, e-stamped via SHCIL (shcilestamp.com) or bought from a licensed vendor. Chandigarh: Article 4, Schedule I to the Indian Stamp Act, 1899 as extended to the Union Territory, non-judicial stamp paper, commonly Rs 10, from SHCIL or the Treasury, Sector 17.

Registration

Not a registrable instrument. Filed with the Police Clearance Certificate application at the Punjab Police (Saanjh Kendra or district police office) or the Chandigarh Police, or with the employer or consulate that asked for it, which may send it to the police for verification. There is no Sub-Registrar step.

Notarisation

Sworn before a Notary Public (Notaries Act, 1952) or an Executive Magistrate/Oath Commissioner. Where sworn on the spot at a Sewa Kendra (Punjab) or Sampark centre (Chandigarh), that counter's own attesting officer may accept the affidavit in their presence in place of prior notarisation — confirm with the specific counter first.

Witnesses

None required by law for the affidavit itself; it is authenticated by the notary's or attesting officer's seal alone.
