Why you need it

When you need it

The land being sold under section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972 stands in the joint names of more than one recorded co-sharer, and only some of them are selling. This is the sworn no-objection of the co-sharers who are NOT themselves party to the sale, confirming they have no objection to it, filed with the section 118 application alongside the selling Transferor's own affidavit. Use it beside `himachal_section_118_permission_application` and `himachal_transferor_no_landless_affidavit_section_118`. If every recorded co-sharer is selling and each signs the application and the sale papers personally, this separate affidavit is usually unnecessary — it exists for the case where some co-sharers stay out of the transaction but the Collector still needs their concurrence on file. Not for: a general no-objection between co-owners outside a section 118 proceeding — the library's general co-owner consent template covers that. This one is written specifically to accompany a section 118 file and says so on its face.

What follows is written for Himachal Pradesh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Sworn on plain paper or on non-judicial stamp paper of nominal value, as the Collector's office in the district concerned requires for an affidavit filed with a section 118 application — confirm the current denomination before swearing it.

Registration

Not compulsorily registrable. It is filed as an annexure to the section 118 application before the Collector (Deputy Commissioner) of the district in which the land lies, and does not itself need to be presented for registration under the Registration Act, 1908.

Notarisation

Sworn before a Notary Public, an Oath Commissioner, or an Executive Magistrate having jurisdiction where a deponent resides or where the land lies. Where the co-sharers live in different places, each may swear before an officer local to them, provided every signature page is annexed to the same affidavit text.

Witnesses

No attesting witnesses beyond the oath are customary, but confirm the requirement of the particular Collector's office — practice on this varies by district and this template does not reproduce any one district's local format.
