Section 118 land purchase permission
- Section 118 Permission Application (Non-Agriculturist Land Purchase)You are not an agriculturist within the meaning of the Himachal Pradesh Tenancy and Land Reforms Act, 1972, and you want to buy land in Himachal Pradesh — a plot for a house, a shop, an industrial site, or land for a hotel, homestay or other commercial or tourism use. Section 118(1) of that Act bars any transfer of land in Himachal Pradesh — by sale, gift, exchange, lease, mortgage with possession, or the creation of a tenancy — in favour of a person who is not an agriculturist, without the previous permission in writing of the State Government. That power stands delegated to the Collector (the Deputy Commissioner) of the district in which the land lies. This is the application by which that permission is sought, on Form LR-XIV, before the sale deed is executed — not after. For a purchase by sale. Section 118 also reaches gift, exchange, a lease beyond the exempted term, and a mortgage with possession, but this application is drafted for the common case: a non-agriculturist buying land by sale. Not for: an agriculturist buying from another agriculturist (no permission needed); land already held by the Applicant that requires no fresh transfer; a transfer the Act itself exempts, such as one in favour of the State Government, a local authority, or a bank or co-operative society taking a mortgage without possession — confirm the exemption applies before assuming this application is unnecessary. File this with the Transferor's affidavit that the sale will not leave them landless, the co-sharers' no-objection affidavit if the land is jointly held, and your own affidavit that you have not already acquired land under Section 118 elsewhere in Himachal Pradesh — three separate sworn papers this application is written to accompany, not restate.₹99Open
- Transferor Affidavit — Will Not Become Landless (Section 118)You are selling land in Himachal Pradesh to a buyer who is not an agriculturist, and the sale needs the Collector's permission under section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972. This is the Transferor's own sworn affidavit, filed with that application, satisfying the Collector that the sale will not leave you landless or without the means to support yourself and your family. This is one of three sworn papers a section 118 file commonly carries, alongside the application itself and, where the land is jointly held, the other co-sharers' no-objection affidavit. Use it beside `himachal_section_118_permission_application`. Not for: a sale between two agriculturists, which needs no section 118 permission and no landless declaration; or a transferor who is a minor, of unsound mind, or whose share is under the Court of Wards — such a transferor's affidavit is sworn by a guardian or manager, which this template does not attempt to cover.₹199Open
- Co-sharer No-Objection Affidavit (Section 118)The land being sold under section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972 stands in the joint names of more than one recorded co-sharer, and only some of them are selling. This is the sworn no-objection of the co-sharers who are NOT themselves party to the sale, confirming they have no objection to it, filed with the section 118 application alongside the selling Transferor's own affidavit. Use it beside `himachal_section_118_permission_application` and `himachal_transferor_no_landless_affidavit_section_118`. If every recorded co-sharer is selling and each signs the application and the sale papers personally, this separate affidavit is usually unnecessary — it exists for the case where some co-sharers stay out of the transaction but the Collector still needs their concurrence on file. Not for: a general no-objection between co-owners outside a section 118 proceeding — the library's general co-owner consent template covers that. This one is written specifically to accompany a section 118 file and says so on its face.₹199Open
- Buyer Affidavit — No Earlier Land Purchased Under Section 118You are the non-agriculturist buyer applying for permission under section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972, and the Collector needs your own sworn word on whether you have already acquired land in Himachal Pradesh under section 118 before — because permission is capped, and a buyer who already holds land taken under an earlier section 118 order may find that cap works against a further purchase. This affidavit either says you have not, or discloses what you have, so the Collector can weigh the current application correctly. Use it beside `himachal_section_118_permission_application` and the Transferor's own affidavit. Where you are buying jointly with someone else, each buyer swears this affidavit separately.₹199Open
Himachali status and essentiality certificates
- Bonafide Himachali Certificate Application (Form-F) with Supporting AffidavitYou need to establish that you are a bonafide Himachali — for a government post or promotion reserved for domiciles of the State, admission under the Himachal Pradesh domicile quota, or another purpose that calls for proof of bonafide Himachali status. This is the application, made on the departmental declaration commonly called Form-F, together with the sworn affidavit that supports it, filed with the Sub Divisional Officer (Civil) or the Tehsildar of the area where you or your family ordinarily reside. The certificate itself, once the Patwari's verification is complete, issues in Form-G. Not for proving you are an "agriculturist" under section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972 — that is a different and narrower test, turning on who actually cultivates land, not on how long a family has lived in the State. A bonafide Himachali who does not personally cultivate land may still need section 118 permission to buy agricultural land; see the note in the fields below before assuming this certificate changes that.₹99Open
- Essentiality Certificate ApplicationYou are not an agriculturist, and you want to buy land in Himachal Pradesh under section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972 for a purpose OTHER than a dwelling house or a shop — an industrial unit, a hotel, a homestay, or another commercial or institutional use. Permission for that wider class of purpose needs an essentiality certificate first, from the department the proposed use concerns, certifying that the land is essential for the project before the Collector will consider the section 118 application itself. Not for a dwelling house or a shop: the Collector's practice, as currently reported, does not call for an essentiality certificate for either, and applying for one where it is not needed only slows the file down. Confirm the current position before filing regardless — this exemption, and the essentiality-certificate requirement generally, have both been the subject of recent government review. Use it beside `himachal_section_118_permission_application`, and, where the project is a hotel, resort or homestay, alongside `himachal_hotel_resort_lease` or `himachal_homestay_guest_house_lease` if the land is to be leased rather than bought outright.₹99Open
Homestays, hotels and orchard leases
- Homestay Registration AffidavitYou own a house in Himachal Pradesh and want to register it as a homestay or bed-and-breakfast unit under the Himachal Pradesh Home Stay Rules, 2025, made under the Himachal Pradesh Tourism Development and Registration Act, 2002. Registration is done through the Tourism Department's online e-Services Portal, and this sworn affidavit is the declaration you attach to that application, confirming your ownership, residence and compliance with the Rules' conditions. Not the registration application itself, and not a substitute for it — file this alongside the online form, not instead of it. And not for a hotel, resort or a commercial guest house run as a standalone business rather than a family home taking in paying guests; see `himachal_hotel_resort_lease` for that, and `himachal_homestay_guest_house_lease` where the property itself is being taken on lease to run as one.₹199Open
- Homestay / Guest House LeaseYou own a house or building in Himachal Pradesh and are leasing it to someone else to run as a homestay, guest house or bed-and-breakfast — or you are that someone else, taking the premises on lease to operate one. This deed is for exclusive possession handed to the Lessee for a term, at a rent, not for the owner's own family continuing to live there and taking in guests themselves. Read the registration note before you assume this lease alone lets the Lessee call the establishment a "Homestay". The Himachal Pradesh Home Stay Rules, 2025 are written around an owner living in the property and letting out spare rooms; a Lessee who is not the owner commonly cannot register under those Rules at all, and instead needs to register the establishment as a guest house or other tourism establishment under the Department of Tourism's general registration. This deed lets the Parties record which track they intend and does not itself decide the question. Not for a homestay run by the owner in their own home — see `himachal_homestay_registration_affidavit` for that. Not for a larger hotel or resort operation — see `himachal_hotel_resort_lease`.₹1,499Open
- Hotel / Resort LeaseAn owner is leasing a building in Himachal Pradesh — already built or purpose-built — to an operator to run as a hotel or resort, for a term of years, at a rent or a minimum-assured-rent-plus-revenue-share. This is a larger and more capital-intensive arrangement than `himachal_homestay_guest_house_lease`: more rooms, a longer term to justify the operator's fit-out spend, and its own licensing (hotel registration, a bar licence if liquor is served, fire and food-safety approvals) that a homestay does not usually carry. Not for a family home let out a few rooms at a time — see `himachal_homestay_guest_house_lease` or `himachal_homestay_registration_affidavit` for that. Not for a management contract where the owner keeps operating the hotel and only engages a brand or manager — that is a services agreement, not a lease, and this deed assumes the Lessee takes exclusive possession and runs the establishment in its own right.₹1,499Open
- Apple Orchard LeaseYou own a bearing apple orchard in Himachal Pradesh and want to lease it out — for cash rent, for a share of the crop, or both — to someone who will maintain it and take the harvest for the term of the lease. Or you are that lessee. READ THIS BEFORE ANYTHING ELSE. The Himachal Pradesh Tenancy and Land Reforms Act, 1972 restricts leasing out agricultural and horticultural land at all: as a general rule an owner who can personally cultivate is expected to, not to let the land out to someone else. Section 104 of that Act carves out the landowners who MAY lawfully lease out their holding — broadly, a serving member of the Armed Forces, an unmarried woman or one who is divorced, judicially separated or widowed, a minor, and a person permanently unable to cultivate through physical or mental infirmity. This deed asks the Lessor which of those categories applies, or records the other basis relied on, because an orchard lease granted by a landowner who does not fit within section 104 risks being void as against the very statute meant to protect small landholding, whatever the parties privately agree. Separately, where the Lessee is not an agriculturist, section 118 of the same Act may require the Collector's permission for this lease in its own right — see `himachal_section_118_permission_application`.₹1,499Open
