Why you need it

When you need it

Use this when closing a loan early — often for a lower rate elsewhere — and need the lender's exact payoff amount, how long it holds, a head-wise breakdown, and its full document list, asked for now, before payment (the new lender won't release sanction without it). It also records, where the facts fit, that no foreclosure charge is payable, and asks the lender to confirm in writing if it disagrees. Don't use this if: you're not the named borrower (POA/heir/company officer needs a different letter); the account is NPA or in settlement talks; you're disputing charges already levied (this asks for a quote, not a complaint); you want a part-prepayment figure; or your lender isn't RBI-regulated — the RBI directions and escalation route won't apply.

What follows is the position for this kind of document. The amount is set by the state the property is in and it changes, so the figure for your own state is worth confirming at the sub-registrar’s office before you pay anything.

Stamp duty

None — a request letter, no right in property or money created; not chargeable under any State schedule. Plain paper, no stamp needed. (The loan agreement was stamped at the start; closure isn't a fresh stampable event.)

Registration

None — creates no property right (s.17). Registration comes later: mortgage discharge and removing the charge from CERSAI/Sub-Registrar/RoC/RTO are the lender's own steps, with committed dates.

Notarisation

None — some branches ask out of habit; there's no legal basis, so ask in writing which rule requires it. Exception: a POA signature — the POA itself needs proper stamping and, depending on the State, notarisation or registration.

Witnesses

None — the lender checks your signature against its records, not a witness. Only the borrower's and every co-borrower's signatures matter.

THE FORECLOSURE STATEMENT

  1. Please issue a foreclosure statement — also called a foreclosure quote, pre-closure statement or loan closure statement — computed as on 2 April 2026, and please show each of the following as a separate line rather than as one consolidated figure.

3.1 The outstanding principal as on 2 April 2026.

3.2 Interest accrued and unpaid up to 2 April 2026, together with the rate applied and the period over which it has been computed.

3.3 The per-day interest that will accrue after 2 April 2026, so that I can work out the exact amount payable on the day the money actually reaches you.

3.4 Every other amount you propose to recover, each shown separately, and for each one: (a) the head under which it is claimed; (b) the amount; (c) the clause of my loan agreement or the entry in the Key Facts Statement or sanction letter under which it is claimed; and (d) the Goods and Services Tax on it, shown separately.

3.5 Any amount lying to my credit that must be set off, including instalments paid in advance, amounts held in suspense, and any refund due to me on insurance or other add-on products that were funded out of this loan.

3.6 The total amount payable, and the date up to which that total holds good — that is, the validity date of the quote.

3.7 The exact mode of payment you will accept and the full beneficiary details, including the account number and IFSC if payment is to be made by NEFT or RTGS.

  1. If the statement includes any penal charge, please show it as a charge and not as penal interest added to the rate of interest, and please confirm that no further interest has been computed on it. That is what the Reserve Bank of India's circular "Fair Lending Practice - Penal Charges in Loan Accounts" dated 18 August 2023 requires.
  1. Please also confirm that every charge appearing in the statement was disclosed to me in advance. Under the Reserve Bank of India's circular "Key Facts Statement (KFS) for Loans & Advances" dated 15 April 2024, which applies to retail and micro and small enterprise term loans sanctioned on or after 1 October 2024, charges not mentioned in the Key Facts Statement cannot be levied at any stage during the term of the loan without my explicit consent. If any charge in the statement was not disclosed to me in the Key Facts Statement or in the sanction letter, please identify it and state the basis on which you claim it.
