Why you need it

When you need it

For a live secured retail loan, get the lender to state in writing exactly which documents it holds — the letter a balance transfer runs on, since a new lender won't sanction without a certified list. Also useful before selling the property, self-funded closure, or checking the bank still holds your title chain. It fixes what each entry must show (type, date, parties, original/copy, pages, registration particulars), forces the bank to flag a missing document, and asks where the deeds are physically kept. Don't use if: the loan is in default/recalled/SARFAESI; the borrower died (a succession claim instead); the loan is repaid and you want originals back (a stronger release letter); or it's someone else's file. Assumes you're a named borrower — not a POA holder or guarantor alone.

None — a request letter, not an instrument; creates no right, transfers no property, secures no money. Plain paper, no stamp needed. (A stamped indemnity bond applies only when originals are actually handed over — a different, later document.)

Registration

None — s.17, Registration Act 1908 doesn't cover a bank letter, or the list you get back.

Notarisation

Not required — adds cost and delay, no legal weight. If a branch insists, ask for its circular reference in writing; save the affidavit route for a lost original or an heir's claim.

Witnesses

None — what matters is your signature (and every co-borrower's) matching the bank's specimen; carry photo ID if it's changed since sanction.

Dear Sir / Madam,

1. The account. I am a borrower in Loan Account No. 38291746502, a Home Loan with your branch. My customer identification number with you is CRN 90218374. The loan was sanctioned on 1 April 2026 under sanction letter reference SBI/HL/BLR/2019/44821, and is secured by a mortgage in your favour of the property described in paragraph 2 below. This is a joint loan. The co-borrower or co-borrowers in this account, Anita Mehra, join in this request; the word "I" in this letter means all of us, and each of us has signed at the foot of this letter. The loan was originally sanctioned by Housing Development Finance Corporation Limited and now stands in your books, and I understand that the loan file was taken over along with it.

2. The security. The property mortgaged to you is: Flat No. 402, 4th Floor, Sunrise Residency, constructed on Survey No. 118/2, Koramangala 4th Block, Bengaluru 560034, admeasuring 1,240 sq. ft. of super built-up area, together with one covered car parking space.

3. Why I need the list. I require this list for the purpose of a balance transfer of this loan. ICICI Bank Limited has asked me for a certified list of the documents you hold, and cannot take its own process forward until it has one. A precise list, issued by you in writing, is the only way I can plan the next step, and it is the document every other party in this transaction will ask to see first.

4. What I am asking for. Please issue to me a complete list of every document held by you in relation to this loan account and its security, whether the document was deposited by me, by a co-borrower, by a guarantor, by the builder or seller, or was generated by you. Please include documents held in physical form and documents held only as scanned images, and say which is which.

5. How each entry should be identified. So that the list is usable, please set out for each document, in a table:

(a) the nature or type of the document, described in words and not only by an internal code;
(b) the date of the document;
(c) the parties to it, or the name of the issuing authority;
(d) whether what you hold is the original, a certified copy, a registered copy, a notarised copy or a plain photocopy;
(e) the number of pages or sheets, and whether any annexure, plan or schedule forms part of it;
(f) where the document is registered, the registration particulars — the office of the Sub-Registrar, the document or serial number, the year, and the book and volume where these are recorded;
(g) the date on which the document was received by you, and the branch or office that received it.

6. Documents to be covered. Without limiting paragraph 4, please make sure the list covers, so far as they exist on this file:

(a) the title deeds deposited with you, including the sale deed, conveyance deed, gift deed, partition deed, release deed or lease deed under which the property is held;
(b) prior title deeds and the chain of title documents taken by you at the time of sanction;
(c) the agreement for sale, allotment letter, builder-buyer agreement, tripartite agreement and possession letter;
(d) share certificate, society or association membership records, and any no-objection certificate issued by the society or the builder;
(e) approved building plan, commencement certificate, occupancy or completion certificate, and khata, patta, mutation or property card extracts;
(f) encumbrance certificate, non-encumbrance certificate, title search report and valuation report obtained by you;
(g) property tax receipts and other statutory receipts held on file;
(h) the mortgage instrument, and where the mortgage is by deposit of title deeds, the memorandum of entry, the declaration of deposit and the register entry recording the deposit;
(i) documents relating to the registration of your charge, including any filing with CERSAI and its asset or security interest identification number;
(j) original insurance policies over the property or the life of a borrower that have been assigned to you or that record you as the loss payee;
(k) guarantee deeds, guarantor documents and any collateral security documents;
(l) undated or post-dated cheques, NACH or ECS mandates and any security cheques still held by you.
