When you need it

The Contractor on a construction, renovation or trade job is in breach — work badly done, work stopped without cause, unsafe practice, a missed deadline, or a failure to keep to the contract — and you need to put the Contractor on formal written notice: stop work now, put it right within a stated time, or the contract ends, and the work done so far will be measured and settled. This notice only exercises what the contract already allows; read its termination clause first.

It is a notice, not a settlement. For defects found after handover use the Defect Notice to Contractor, and when the account is finally agreed use the Contractor Final Bill and No-Claim Letter.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Not a stamp-dutiable instrument — a notice, not an agreement or a conveyance.

Registration

Not registrable.

Notarisation

Not required. Sending it in a way that proves delivery — registered post, courier with acknowledgement, or email where the contract allows notice by email — matters far more than notarising it.

Witnesses

Not required.

NOTICE TO STOP WORK / NOTICE OF BREACH AND TERMINATION

Reference: House Construction Contract dated 4 January 2026, for work at Plot No. 118, Sector 70, Mohali.

This notice is given under: Clause 7.1 (Termination)

Dear Sir/Madam,

I/We write to place on record the following breaches by you of the contract referred to above:

  1. 1. No work done at the Site since 2 September 2026, despite the completion date of 30 October 2026.
  2. 2. Slab shuttering erected without the agreed supports; work stopped by the Owner’s engineer on 20 August 2026.
  3. 3. Workers engaged without helmets or safety harness at height.

This has already been raised with you: Raised by WhatsApp message on 10 September 2026 and by letter on 18 September 2026, with no reply

WHAT YOU ARE REQUIRED TO DO

You are directed to stop work at the Site immediately and not to resume until the Owner confirms in writing that the grounds above have been put right.

The cure period is 15 days from the date of this notice.

You are also required to keep the Site secure, to protect the work done and the materials on it, and to hand over to me/us on request all keys, drawings and any materials or items belonging to me/us. Your tools, equipment and surplus materials may be removed only after a joint inventory is made.

THE WORK DONE SO FAR

The work stands as follows: Plinth and ground-floor slab completed; first-floor brickwork about half done. Running Bills 1 to 3 certified and paid.

Total paid to you so far: ₹18,00,000 (Rupees Eighteen Lakh only).

Retention/security held under the contract: ₹90,000 (Rupees Ninety Thousand only).

The work done up to the date of stopping will be jointly measured and valued at the contract rates, and the amount found due will be settled after setting off the advance paid, the retention held and the Owner’s cost of rectifying or completing the work.

I/We propose that the joint measurement be made at the Site on 1 April 2026. Please attend or send a representative; if you do not, the measurement may be made in your absence.

Nothing in this notice is a waiver of any right of mine/ours under the contract or in law, including the right to recover any loss caused by the breaches above. Any step taken by me/us after this notice, such as securing the Site or measuring the work, is without prejudice to those rights.

Sent by: Registered post with acknowledgement due, and by email to the Contractor’s registered email address

Yours faithfully,
