When you need it

A contractor has waterproofed your terrace, bathrooms, balcony, basement or tank and you want the guarantee in writing, signed by the contractor, rather than a promise on the phone. It records the areas covered, the method and materials, the period, how quickly the contractor must attend and repair, what is not covered, and your own duties.

Use it with the contract for the work itself — for the work, use the Interior Work Contract (Home or Office) or the House Construction Contract (Owner–Contractor). Not for a defect notice to a contractor who is refusing to repair — use the Defect Notice to Contractor.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Chargeable as an agreement or undertaking — this document transfers no interest in the Site. Which article applies to a one-sided written guarantee should be confirmed at the Sub-Registrar’s counter. PUNJAB: Article 5, Schedule I-A to the Indian Stamp Act, 1899 as applicable in Punjab; the residuary rate under Article 5(c) where no more specific sub-clause fits. Confirm the current figure with the Sub-Registrar or against the Department of Revenue, Rehabilitation and Disaster Management's published table at revenue.punjab.gov.in before the stamp is bought. CHANDIGARH: the equivalent agreement article under the Chandigarh Administration's Rates of Stamp Duty & Registration Fees table at revenue.chd.gov.in; confirm the current figure at the Sub-Registrar's office, 30 Bays Building. Buy the e-stamp before signing.

Registration

Not compulsorily registrable under section 17 of the Registration Act, 1908 — it creates no interest in immovable property. Optional registration under section 18 is available but rarely used for a document of this kind.

Notarisation

Not legally required. Notarising is sometimes done to fix the date the document was signed, which can matter if the timeline is later disputed.

Witnesses

Not legally required for a document of this kind. Two witnesses are provided for below, since a guarantee is often relied on years later, when the people who saw it signed are the best proof of it.

2.2 This Warranty is in addition to the Owner's other rights and remedies against the Contractor under the law.

3.2 The Contractor shall attend the Site within 7 days of the complaint, find the cause, and complete the repair within 15 days of attending, at its own cost for materials and labour.

3.3 The Contractor shall also restore the tiles, plaster and finishes it has to remove to carry out the repair.

3.4 A repaired area is covered afresh for the longer of the remaining Warranty Period and twelve months from the date of the repair.

3.5 If the Contractor does not attend or complete the repair within these times, the Owner may, after seven days' written notice, have the repair done by another contractor and recover the reasonable cost from the Contractor.
