Why you need it

When you need it

The buyer's own application to the committee: admit me, transfer the outgoing member's shares to my name. Buying the flat alone doesn't make you a member — the agreement gives title, only the committee's resolution gives membership. For a Maharashtra society (MCS Act 1960, Model Bye-laws 2014); covers purchase, gift, or transmission to a nominee/heirs. Not for an AOA; not other states without resetting citations; not a company/firm/trust/HUF purchaser.

Stamp duty

No ad valorem duty on the application — a committee request, not a conveyance. Duty sits on the underlying instrument: the sale agreement (Art.25) or gift deed (Art.34, concessional for specified family), Maharashtra Stamp Act. A declaration/indemnity bond takes the nominal affidavit rate (Rs 100, Maharashtra). Under-stamped, inadmissible (s.34), impoundable (s.33).

Registration

The application isn't registrable. What must be: a gift deed, compulsorily under s.17(1)(a), Registration Act 1908 with s.123, TP Act 1882; an agreement for sale, under s.17(1A) read with s.13, RERA 2016 (older Maharashtra: s.4, MOFA). Either within 4 months (s.23), condonable 4 more on a fine up to 10x the fee (s.25); unregistered, inadmissible (s.49). The society's register entry/endorsement is a record, not registration.

Notarisation

Not required for the application. Societies often want the declaration sworn, and a death-case indemnity bond — before a notary/oath commissioner, on prescribed stamp paper. Notarisation authenticates signature/oath only; cures no missing duty, registration or title defect.

Witnesses

None on the application — witnesses belong on the underlying instrument: a gift needs two attesting witnesses (s.123, TP Act 1882); a death-case indemnity bond, two disinterested witnesses. Society side: none — admission/transfer take effect by committee resolution in quorate minutes.

Dear Sir / Madam,

1. The applicant

1.1 I, Aarav Ramesh Sharma, son of Shri Ramesh Kumar Sharma, by occupation chartered accountant, presently residing at X, apply to be admitted as a member of the Society.

1.2 I may be reached on X and at X. My Permanent Account Number is ABCPS1234K.

1.3 The flat has been acquired jointly with X, wife of Shri Aarav Ramesh Sharma, who joins in this application. The joint applicant's Permanent Account Number is X. We request that the name of Aarav Ramesh Sharma be entered first in the share certificate and in the register of members, and that X be admitted as an associate member within the meaning of section 2(19)(a) of the Act. We understand that an associate member exercises the rights of a member only to the extent the Act and the bye-laws allow, and in particular may vote only with the written authority of the member whose name stands first.

2. The flat and the shares

2.1 This application concerns Flat No. B-1204, Wing B, Shreeji Krupa Tower, on the 12th floor, in the building of the Society at X, admeasuring 58.60 sq. m. (630 sq. ft.) carpet (the Flat).

2.2 The shares to be transferred are 10 fully paid-up shares bearing distinctive numbers 1111 to 1120 (both inclusive), of the total face value of ₹500 (Rupees Five Hundred only), comprised in Share Certificate No. 112 standing in the name of Shri Vinod Balkrishna Patil (the Shares), together with the interest of the holder of the Shares in the capital and property of the Society attaching to the Flat.

2.3 The stilt parking slot no. 24 has been in use with the Flat. I request the Committee to confirm the position on that slot. I understand that parking is allotted by the Society under its bye-laws and the resolutions of the general body, that it does not pass automatically with the Flat or with the Shares, and that I must apply for allotment in my own name.

3. Basis of the transfer

3.1 The transfer for which admission is sought arises from: Sale of the flat by the existing member to the applicant.

3.2 The Flat was sold to me by an agreement for sale dated 3 April 2026, duly stamped and registered under Sr. No. TNN-4/8821/2026, Sub-Registrar Thane No. 4, for a consideration of ₹1,45,00,000 (Rupees One Crore Forty Five Lakh only). A certified copy of that agreement, with the index-II and proof of payment of stamp duty and registration fee, is enclosed. I confirm that the outgoing member has, to my knowledge, held the Shares for not less than one year, as section 29(2)(a) of the Act requires, and that the outgoing member has given the Society the clear fifteen days' notice in writing of the intention to transfer required by Rule 24 of the Rules read with bye-law 38.

3.4 Shri Vinod Balkrishna Patil, the member in whose name the Shares stand, died on 5 April 2026. The death certificate is enclosed. There is no instrument of transfer, because the interest devolves by operation of law and not by conveyance; I therefore apply for the Shares to be transmitted to me and for my admission as a member in place of the deceased.

3.5 Possession of the Flat was taken, or is to be taken, on 7 April 2026.

4. Qualification for membership

4.1 I am competent to contract, of sound mind, and not disqualified from membership under section 22 of the Act or under the registered bye-laws of the Society.

4.2 I am not carrying on, and shall not carry on, any business or activity in conflict with, or in competition with, the business of the Society.

4.3 I hold no interest in the Flat adverse to the interest I have disclosed above, and I have disclosed the whole of the basis on which I claim.
