No-dues, NOCs and permissions
- Statement of Unpaid Common Expenses (Association No-Dues Certificate)Before money changes hands on a Mohali, Zirakpur, Dera Bassi, New Chandigarh, Kharar, Ludhiana or Chandigarh-sector flat, get the association's statement of what's owed and its clear-up-to date. Punjab apartments: unpaid common expenses charge the flat (s.26, Punjab Apartment Ownership Act, 1995); a purchaser is jointly/severally liable for all arrears up to transfer (s.27(1)) — inherited with the flat. S.27(2) is the escape: any purchaser may demand this statement from the Board of Management and is then liable only to the stated amount. Two consequences shape this template: the right belongs to the PURCHASER (form records who's asking; a purchaser's demand letter is an alternate cover page), and the ceiling applies only where the Act is notified — NOT in Chandigarh (no apartment-ownership statute; Chandigarh Apartment Rules, 2001 repealed from 1 October 2007). The form records body type and location so a Chandigarh flat can't claim the Punjab ceiling; the statutory-charge paragraph prints only if the association confirms both — otherwise it defaults to: no ceiling, hold a retention. Needed at: resale (before completion); loan sanction/mortgage release; transfer to nominee/heirs on death or gift; a Chandigarh co-op society's membership substitution (Registrar clearance); or account closure. NOT an NOC (NOC = no objection to transfer; this = money is clear) — most transfers need both, same day; match names/flat number on each. NOT the Estate Office No Dues Certificate (Estate Office, Town Hall Building, Sector 17-C, Chandigarh — ground rent/lease money/extension fee/penalties on the SITE, a government document) — a Chandigarh leasehold sale needs both. Value sits in one date: 'dues paid till date' is worthless (quarterly-advance billing from 1 April already collected to 30 June; arrears billing, only to 31 March). This template states three dates separately — bills raised to, payment credited to, and the Clear-Up-To Date — with a self-check, and fixes what happens to a later-found earlier-period charge. NOT for: (1) no registered body, promoter/agency still running accounts (common in Zirakpur, Dera Bassi, peri-urban Mohali, promoter never applied under s.17) — use the agency's own clearance letter instead (contractual, not a charge on the flat); the promoter's non-registration is itself a default under s.17 (apply within 3 months of the allotment/sale threshold after the OC, else the allottee may; threshold was one-third, s.17 substituted by Punjab Act 17 of 2021, reportedly moved). (2) Estate Officer leasehold clearance or Chandigarh Housing Board clearance — go there instead. (3) A Phase-I Chandigarh unit's floor-wise co-owner division — barred: Supreme Court, 10 Jan 2023 (Residents Welfare Association v. UT Chandigarh) bars such fragmentation and any co-owner MOU for it; the Estate Officer's notice effective 10 Feb 2023 also stopped transfers/mutations outside four permitted categories pending the Heritage Conservation Committee — status unconfirmed when drafted; clause 20 states this. Get: one signed original on letterhead (outward-register reference, seal, Hon. Secretary plus normally President/Chairperson) — ask for two, plus a 2-3 year ledger extract and the last three receipts. The certificate is only as good as the books behind it.₹99Open
- Society Parking Allotment LetterFor a committee allotting parking — first allotment, renewal, vehicle change, or a fresh draw — establishing that the society allots USE, not a sale. Open/stilt parking is common property (Nahalchand Laloochand v. Panchali Co-op HS, (2010) 9 SCC 536) — unsellable by promoter or member. For Maharashtra, Karnataka, Delhi, Gujarat, Tamil Nadu, West Bengal. Not for an AOA/RWA (Deed of Declaration governs); not a saleable owned garage or a builder-controlled society.₹99Open
- NOC for Interior Renovation Work (Society to Member)The committee's written permission for interior work — flooring, ceiling, kitchen, wardrobes, painting, in-flat rewiring, bathroom fittings — with allowed scope, hours, debris removal, deposit and damage indemnity. For ordinary interior work; refuse anything touching a structural member, elevation, common areas, or a toilet/duct's position without a structural engineer's certificate and municipal permission (optional clause covers that). Not for a merger, balcony enclosure, loft or built-form change; not redevelopment, pre-possession fit-out, or a tenant applicant.₹99Open

- Minutes of the Annual General Meeting (Co-operative Housing Society)The Society's only proof of what its general body decided; an unminuted decision is hard to prove to the Registrar, a bank or an auditor. For a Punjab/Chandigarh AGM under the Punjab Co-operative Societies Act, 1961, 1963 Rules and bye-laws — covering minutes confirmation, annual report, accounts, profit, auditor, budget, admissions, bye-law amendments, property, committee election, special business, plus presiding officer, notice, defaulters, quorum, voting. - Resolution of the Managing CommitteeA committee's decisions bind the society only if properly convened and empowered — recording meeting particulars, notice, quorum, the empowering provision, the resolution, and a certified extract for a bank/contractor/Registrar. For what the committee itself may decide (contractor appointment within limit, bank operation, authorising a signatory, routine repairs) — not bye-law amendments, spending/borrowing beyond limit, disposing of property, or the sinking fund (general body only), nor a general-body resolution. - Complaint to the Registrar of Co-operative SocietiesWhen a committee won't transfer a flat, show records, hold the AGM, or spend within authority, complain in writing to the Registrar of Co-operative Societies for the ward/taluka: correct addressee, your capacity, dated facts, the provision breached, relief sought.
