When you need it

A member files this to name who receives shares/interest on death. S.30, Maharashtra Co-operative Societies Act 1960 with Rule 25, MCS Rules 1961 obliges transfer to the nominee once death is proved; with none recorded, the family faces the slower heirship-certificate/indemnity route. Revokes every earlier nomination; works only once the society enters it while you're alive (Rule 25(4)) — deliver to the secretary, get the acknowledgement. Not a will — a nominee takes as trustee for the heirs. Not for an AOA (e.g. Maharashtra Apartment Ownership Act 1970) — no shares, no s.30 nomination. Always names a nominee — to revoke without one, write separately.

Stamp duty

None — a nomination transfers nothing in the member's lifetime, so no Stamp Act article charges it; plain paper suffices. A Rs 100 stamp-paper habit some offices insist on isn't required and doesn't cure a defective nomination. Releasing/gifting/transferring the flat now is a different, stampable instrument at gift/conveyance rates.

Registration

Not registrable — creates no property right (s.17 inapplicable), shares are movable anyway. What matters: entry in the society's Register of Nominations, which s.30 operates off. Deliver for a dated acknowledgement and get the register serial number in writing — unentered, it's what heirs litigate over.

Notarisation

Not required — neither s.30 nor Rule 25 needs it. Some committees insist for a change of nomination — check bye-laws. Worth doing voluntarily where the member is elderly or a family contest is likely — a notary's endorsement and a doctor's soundness-of-mind note are cheap evidence.

Witnesses

Sign before two adult witnesses who watch you sign, with full names/addresses — nominations are routinely attacked as forged or coerced. Don't use the nominee, their spouse, or a minor nominee's guardian as witness. Thumb impression: have witnesses identify/attest it, preferably notarised.

1.1 I, Sunita Ramesh Kulkarni, son of Late Ramesh Vitthal Kulkarni, aged about 68 years, am a member of Shanti Nivas Co-operative Housing Society Ltd., a co-operative housing society bearing Registration No. MUM/WR/HSG/TC/12345/2004-05 and having its registered office at X ("the Society").

1.2 I am in occupation of, and hold the Society's shares relating to, Flat / Unit No. B-704 in Sagar Wing in the Society's building ("the said Flat").

1.3 I hold 5 fully paid-up shares of the Society covered by Share Certificate No. 047. The distinctive numbers of those shares are 231 to 235. My membership number in the Society's Register of Members is M-118.

1.4 In this form, "the said shares and interest" means those shares together with the whole of my right, title and interest in the Society and in the said Flat as a member of the Society.

2. AUTHORITY FOR THIS NOMINATION

2.1 This nomination is made under Section 30 of the Maharashtra Co-operative Societies Act, 1960 read with Rule 25 of the Maharashtra Co-operative Societies Rules, 1961, and under the registered bye-laws of the Society.
