When you need it

Before money changes hands on a Mohali, Zirakpur, Dera Bassi, New Chandigarh, Kharar, Ludhiana or Chandigarh-sector flat, get the association's statement of what's owed and its clear-up-to date. Punjab apartments: unpaid common expenses charge the flat (s.26, Punjab Apartment Ownership Act, 1995); a purchaser is jointly/severally liable for all arrears up to transfer (s.27(1)) — inherited with the flat. S.27(2) is the escape: any purchaser may demand this statement from the Board of Management and is then liable only to the stated amount. Two consequences shape this template: the right belongs to the PURCHASER (form records who's asking; a purchaser's demand letter is an alternate cover page), and the ceiling applies only where the Act is notified — NOT in Chandigarh (no apartment-ownership statute; Chandigarh Apartment Rules, 2001 repealed from 1 October 2007). The form records body type and location so a Chandigarh flat can't claim the Punjab ceiling; the statutory-charge paragraph prints only if the association confirms both — otherwise it defaults to: no ceiling, hold a retention. Needed at: resale (before completion); loan sanction/mortgage release; transfer to nominee/heirs on death or gift; a Chandigarh co-op society's membership substitution (Registrar clearance); or account closure. NOT an NOC (NOC = no objection to transfer; this = money is clear) — most transfers need both, same day; match names/flat number on each. NOT the Estate Office No Dues Certificate (Estate Office, Town Hall Building, Sector 17-C, Chandigarh — ground rent/lease money/extension fee/penalties on the SITE, a government document) — a Chandigarh leasehold sale needs both. Value sits in one date: 'dues paid till date' is worthless (quarterly-advance billing from 1 April already collected to 30 June; arrears billing, only to 31 March). This template states three dates separately — bills raised to, payment credited to, and the Clear-Up-To Date — with a self-check, and fixes what happens to a later-found earlier-period charge. NOT for: (1) no registered body, promoter/agency still running accounts (common in Zirakpur, Dera Bassi, peri-urban Mohali, promoter never applied under s.17) — use the agency's own clearance letter instead (contractual, not a charge on the flat); the promoter's non-registration is itself a default under s.17 (apply within 3 months of the allotment/sale threshold after the OC, else the allottee may; threshold was one-third, s.17 substituted by Punjab Act 17 of 2021, reportedly moved). (2) Estate Officer leasehold clearance or Chandigarh Housing Board clearance — go there instead. (3) A Phase-I Chandigarh unit's floor-wise co-owner division — barred: Supreme Court, 10 Jan 2023 (Residents Welfare Association v. UT Chandigarh) bars such fragmentation and any co-owner MOU for it; the Estate Officer's notice effective 10 Feb 2023 also stopped transfers/mutations outside four permitted categories pending the Heritage Conservation Committee — status unconfirmed when drafted; clause 20 states this. Get: one signed original on letterhead (outward-register reference, seal, Hon. Secretary plus normally President/Chairperson) — ask for two, plus a 2-3 year ledger extract and the last three receipts. The certificate is only as good as the books behind it.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty — a ledger statement creates/transfers/extinguishes no right, so no Schedule I-A article (Indian Stamp Act, 1899) reaches it, Punjab (as amended) or Chandigarh (as continued). Print on letterhead; stamp paper confuses it with an affidavit. What the transaction itself costs: Punjab conveyance/sale deeds draw 5% duty plus 1% Social Infrastructure Cess plus 1% PIDB levy, 1% registration fee (capped Rs 2,00,000), facilitation charges Rs 1,000/3,000/5,000 (up to Rs 10 lakh / Rs 10-30 lakh / above Rs 30 lakh), Rs 200 pasting fee, Rs 600 mutation fee, on consideration or the higher Collector rate (revenue.punjab.gov.in, checked 6 Sept 2026; portals wrongly quote a flat 7%). Chandigarh: 5% (Administration's table; Tribune, 28 March 2026 agrees; portals wrongly say 6%), registration fee capped Rs 10,000 (Sub Registrar, 30 Bays Building, Sector 17) — both tables undated/unnumbered, treat as checked 6 Sept 2026; Chandigarh collector rates rose 33.2% from 1 April 2026 (Sectors 1-12: Rs 2,37,900/sq yd). No gender concession is confirmed in either place. A sworn version is a Hon. Secretary affidavit, chargeable under Article 4, Schedule I-A — buy as e-stamp via SHCIL, Sewa Kendras (Punjab) or the Sub Registrar's counter (Chandigarh); no notification fixes the denomination, confirm on the day. An appeal under s.33, Punjab Apartment Ownership Act, 1995 needs a Rs 15 court-fee stamp (Rule 11(2), PAOR 1995). Clause 13's optional undertaking (not enforcing the charge against a purchaser) is arguably chargeable under the residuary agreement article — practice leaves it unstamped regardless; for certainty, the Collector can adjudicate under s.31, Indian Stamp Act, 1899 (Deputy Commissioner, Punjab/Chandigarh).

Registration

Not registrable — s.17, Registration Act, 1908 reaches only instruments creating/extinguishing property rights ≥Rs 100 (plus s.17(1A)/(2)); a ledger statement isn't one, but is admissible unregistered as the association's own statement (force: s.27(2), PAOA 1995). The association logs it in the outward register and places the transfer before the Board/Committee. Registrable instead: Punjab's conveyance deed of apartment — compulsory under s.16(1), PAOA 1995, in the Form 'C' register with a Form 'D' index (Rule 7, PAOR 1995); the transferee-particulars endorsement (s.14(4)) is itself compulsory, certified copy to the Competent Authority (s.16(4)); before the tehsil Sub-Registrar (99 tehsils, 81 sub-tehsils; DC is Registrar/Collector; NGDRS live in 22 districts). Chandigarh: Sub Registrar, U.T., 30 Bays Building, Sector 17 (ngdrs.chd.gov.in). Timing: (1) get this BEFORE the deed is presented — Chandigarh mutation auto-triggers from the Sub-Registrar since 2025, no later fix; a leasehold sale needs the Estate Officer's prior NOC (Town Hall Building, Sector 17-C, 160017) first. (2) File Punjab's Form 'A' undertaking within 90 days (Rule 4, PAOR 1995, Gazette Part 3, 1.12.1995) — free, two witnesses, most commonly missed. (3) STOP-SIGN: the Estate Officer's notice effective 10 Feb 2023 (after the Supreme Court's 10 Jan 2023 judgment, RWA v. UT Chandigarh) permits only four residential-dealing categories pending the Heritage Conservation Committee — a whole-property purchase by one person/family qualifies; a part-unit or non-family sale doesn't, stopping both transfer and mutation (CHB tenements, Chandigarh Apartment Rules 2001 apartments unaffected). Status unconfirmed as of 6 Sept 2026 — check before closing (clause 20 warns of this). Chandigarh co-op society: no conveyance — membership changes via Committee admission/share-certificate transfer, substitution to the Registrar, Co-op Societies, U.T. Chandigarh where earlier membership was surrendered/expelled/cancelled (RCS Memo Coop/HB/2KI/3890, 05.10.2001; letter 08.06.2006); land usually a 99-year lease under the 1991 Scheme (notified 28.05.1991).

Notarisation

Not required, normally inappropriate — weight comes from the seal and a committee resolution, and (Punjab AOA) s.27(2), PAOA 1995, capping liability; a notary only attests a signature, not the books. Some banks (Chandigarh resale-loan branches especially) still ask: if unavoidable, the Hon. Secretary signs and the notary attests under s.8(1)(a), Notaries Act, 1952 (Punjab notaries: State-appointed; U.T.: Centre), fee per Rule 10, Notaries Rules, 1956 (market Rs 100-500). For an NRI file or overseas probate needing apostille: MEA apostilles after pre-authentication by Punjab's or Chandigarh's Home Department; an unnotarised certificate can't be apostilled.

Witnesses

No witnesses — not an executed instrument like a conveyance, gift or will (contrast the Form 'A' undertaking, filed within 90 days, which DOES need two — commonly confused with this). Internal authority replaces witnesses: (1) a Board/Committee resolution authorising issue, dated with an item number, in the minute book and printed on the certificate (clause 19) — a Secretary-only signature with no resolution is disownable; if clause 13's undertaking or the statutory-charge confirmation is included, check the cited resolution actually covers it, and that the Committee confirmed the area notification BEFORE authorising. (2) The Hon. Secretary's signature. (3) The President's/Chairperson's signature — usual, bank-preferred; add the Treasurer if the body has one. (4) The seal — its absence is the top reason certificates bounce at bank counters. Check the body's own bye-laws first — they override general practice. An AOA follows the Model Bye-laws, 1995 (Schedule to PAOR 1995); departures need the Competent Authority's approval under s.20(3). Model bye-law 6: an owner over 60 days in default is disqualified from Board election. A co-op society's own bye-laws name signatories; committee capped at 21 members, 5-year term under s.26, Punjab Co-operative Societies Act, 1961 (the Act's printed model: 7 members, 3 years) — the Registrar-approved bye-laws govern where they conflict.

STATEMENT OF UNPAID COMMON EXPENSES / NO-DUES CERTIFICATE

  1. THE ASSOCIATION. Sunny Enclave Apartment Owners' Welfare Association is an association of apartment owners in the State of Punjab, registered by the Competent Authority under the Punjab Apartment Ownership Act, 1995, bearing Registration No. Form 'E' No. 17 of 2019, issued by the Competent Authority-cum-Sub Divisional Magistrate, Dera Bassi, having its registered office at X. In this certificate it is called "the Association", and its Board of Management or Managing Committee, by whichever name its own bye-laws call it, is called "the Committee". The description printed in this clause states both what kind of body the Association is and where it is, in one breath and from one answer, so that the two can never contradict each other; every other clause of this certificate is to be read against it.
  1. THE MEMBER. Smt. Harpreet Kaur Sidhu, wife of S. Jagdeep Singh Sidhu, is a member of the Association, bearing Membership No. M-084, admitted to membership on 2 April 2026. In this certificate that person is called "the Member".

Joint holding — the apartment and, where shares are issued, the shares, are held jointly by the Member together with X. This certificate is issued in respect of the joint holding, and both holders are together referred to as "the Member".

Deceased member — the Association records that X, the member in whose name the apartment stands on its records, is deceased. This certificate is issued in respect of the apartment of the deceased member and speaks only to the state of the Association's accounts. It says nothing about who is entitled to the apartment, to the shares, or to membership, and it is not a transmission order.

Handed to — the certificate is handed to Sh. Sukhdeep Singh Sidhu, son and nominee recorded under section 21 of the Punjab Co-operative Societies Act, 1961, who has applied for it in that capacity. The Association has not adjudicated any question of succession, and this certificate confers no right of membership. Membership on the death of a member of a co-operative house building society passes under section 21 of the Punjab Co-operative Societies Act, 1961 and the society's own bye-laws, and in an apartment owners' association it follows the conveyance deed of apartment; neither route is decided by this certificate.

Attorney — the application for this certificate was made on behalf of the Member by Sh. Rajan Sidhu, holder of a registered power of attorney dated 12-02-2024, registered with the Sub-Registrar, S.A.S. Nagar (Sr. No. 1882 of 2024).

  1. THE APARTMENT. The certificate relates to Flat No. B-1104, Tower B, 11th floor, Sunny Enclave Heights, admeasuring 1,240 sq. ft. super area (carpet area 985 sq. ft.), situate at X, on land bearing Khasra No. 512/2, Hadbast No. 214, Village Kumbra, Tehsil and District S.A.S. Nagar. In this certificate it is called "the said Apartment".

Parking — the following parking is allotted to the said Apartment and its charges are included in the account certified below: One covered parking, slot no. B-22.

Shares — the Member holds Share Certificate No. 84 issued by the Association, covering shares bearing distinctive numbers 416 to 420 (both inclusive), 5 shares of Rs. 100 each, in respect of the said Apartment. In a co-operative house building society the share certificate, and not a conveyance deed, is the document that records the Member's interest, and it must be produced with this certificate.

  1. WHAT HAS BEEN CHECKED. The Association has examined its books of account, its bill register, its receipt book and the ledger of the Member for the said Apartment for the period from 3 April 2026 up to the date of this certificate. Billing basis: the Association bills its members monthly and in advance.
  1. HEADS COVERED. The account so examined covers every amount that the Association levies on the said Apartment under its registered bye-laws, namely:

(a) monthly maintenance and common-expense charges;
(b) contribution to the sinking fund;
(c) contribution to the repair and maintenance fund;
(d) major repair, special levy and any other one-time contribution already billed;
(e) water charges collected by the Association;
(f) the Member's share of electricity and other charges for the common areas, lifts, pumps, fire systems and generator;
(g) property tax and municipal charges to the extent collected by the Association and paid over on the Member's behalf;
(h) non-occupancy or tenanted-unit charges, where the bye-laws provide for them;
(i) parking, stilt and garage charges;
(j) ground rent or lease money to the extent collected by the Association and paid over to the lessor;
(k) interest and penalty charged under the bye-laws or by a resolution of the general body on delayed payment; and
(l) any other charge levied on the said Apartment under the bye-laws or by a resolution of the general body.

  1. THE OPERATIVE DATES. On the basis of the examination described above, the Association states:

The date marked "THE ACCOUNT IS FULLY CLEAR UP TO" is called the "Clear-Up-To Date", and wherever this certificate speaks of dues being clear, it means clear up to that date and no later.
