Why you need it

When you need it

For a committee allotting parking — first allotment, renewal, vehicle change, or a fresh draw — establishing that the society allots USE, not a sale. Open/stilt parking is common property (Nahalchand Laloochand v. Panchali Co-op HS, (2010) 9 SCC 536) — unsellable by promoter or member. For Maharashtra, Karnataka, Delhi, Gujarat, Tamil Nadu, West Bengal. Not for an AOA/RWA (Deed of Declaration governs); not a saleable owned garage or a builder-controlled society.

Stamp duty

Almost certainly none — a revocable licence to common property, not a conveyance/lease; issue unstamped on letterhead. Risk arises only if dressed as an exclusive long-term right for a lump-sum premium — keep the term short, charge recurring fees not a premium, avoid the words sale/price/transfer/lease/rent.

Registration

Not compulsorily registrable — s.17(1)(d), Registration Act 1908 catches leases year-to-year/over a year/at yearly rent; a parking licence avoids this if the term stays 11 months or less and grants use, not possession (built in). Maharashtra's s.55, Rent Control Act 1999 targets premises on licence, not an internal allotment.

Notarisation

Not required, adds nothing to validity. What decides a challenge: the meeting notice, quorum, resolution number/date, the allotment register, and the signed acceptance. A notarised undertaking that the space wasn't purchased is worth it only where a promoter once purported to sell it.

Witnesses

No statutory requirement — not an instrument needing attestation under s.3, TP Act 1882. Two witnesses on the acceptance are still practice, given disputes over denying agreement to conditions. Stronger safeguard: the authorising resolution, allotment register, and dispatch entry proving service.

Dear Mrs Anjali Ramesh Deshpande,

1. The parties and the authority for this allotment

1.1 Shreeji Heights Co-operative Housing Society Limited ("the Society") is a co-operative housing society registered under the Maharashtra Co-operative Societies Act, 1960 bearing Registration No. MUM/W-K/HSG/(TC)/12345/2009-10, having its registered office at Plot 42, Sector 11, Kharghar, Navi Mumbai 410210. The management of the Society vests in its Managing Committee ("the Committee") under that Act, the Rules made under it, and the registered bye-laws of the Society ("the Bye-laws").

1.2 You, Mrs Anjali Ramesh Deshpande ("the Member"), are a member of the Society on its register of members, holding Share Certificate No. 0187 (distinctive Nos. 931 to 940), and hold Flat No. B-1104, B Wing, Shreeji Heights in the Society's building ("the Flat").

1.3 The Committee is empowered to allot parking spaces to members by Bye-law No. 78 of the registered bye-laws of the Society (based on the Model Bye-laws for Co-operative Housing Societies, 2014), read with the Bye-laws and the resolutions of the general body of the Society.

1.4 Notice of the meeting of the Managing Committee was served on all persons entitled to receive it on 2 April 2026, in the manner and within the time required by the Bye-laws. At that meeting, held on 3 April 2026, at which the quorum required by the Bye-laws was present, it was resolved by Resolution No. 7 of 2026 to allot to the Member the parking space described in the Schedule, on the terms set out below.

2. What this letter grants, and what it does not

2.1 The Society allots to the Member, for the term stated in clause 4 and on the conditions in this letter, the use of the parking space described in the Schedule ("the Parking Space").

2.2 This letter grants a bare and revocable licence to use a part of the common property of the Society. It does not sell, convey, transfer, assign, lease or demise the Parking Space. It creates no ownership, tenancy, sub-tenancy, easement or other right or interest in immovable property in favour of the Member. Possession of the Parking Space remains with the Society at all times.

2.3 The Parking Space is and remains the common property of the Society, held for the benefit of the members as a whole. In Nahalchand Laloochand Private Limited v. Panchali Co-operative Housing Society Limited, (2010) 9 SCC 536, the Supreme Court held that stilt and open parking spaces form part of the common areas of a building and are not separately saleable by the promoter. No amount payable under this letter is the price of the Parking Space, and the Society has received no amount as such a price.

2.4 The Parking Space does not form part of the Flat and is not property appurtenant to it. The Society does not treat the Parking Space as adding to the value of the Flat for the purposes of its own records or the transfer premium payable under the Bye-laws.

3. Basis of allotment

3.1 The allotment has been made on the basis of first come, first served, in the order in which written applications were received from members.

3.2 This is the first parking space allotted to the Member.

3.3 The Society follows the rule that no member is allotted a second parking space while the application of any member who has no parking space remains pending.

4. Term and renewal

4.1 The allotment takes effect on 4 April 2026 and expires on 5 April 2026, unless revoked earlier under clause 9.

4.2 The allotment does not renew automatically. The Member may apply in writing for renewal at least thirty days before expiry. Renewal is at the discretion of the Committee, which will have regard to the applications of members who have no parking space, to any change in the Society's parking plan, and to the Member's compliance with this letter.

4.3 Continued use of the Parking Space after expiry, with or without the Society's knowledge, does not renew the allotment and creates no right in favour of the Member.

5. Charges

5.1 The Member shall pay parking charges of ₹800 (Rupees Eight Hundred only) per month, billed and payable monthly, along with the maintenance bill of the Society. These are charges of the Society levied on a member. They are not rent, not a licence fee for premises, and not consideration for the sale of any space.

5.2 The charges may be revised by the general body of the Society. A revision applies to the Member from the date fixed by the general body, without any amendment to this letter.
