Why you need it

When you need it

Use this when a building departs from its sanctioned plan and you want the authority to rule if it can be compounded or must be removed. Chandigarh's rules distinguish sanctionable, compoundable and non-compoundable departures — the last removed before occupation; Punjab has its own rules. A fee alone doesn't entitle you to keep a non-compoundable deviation.

See stamp duty, registration and witnesses

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty: creates no right in property, not an instrument under section 2(14), Indian Stamp Act, 1899. The compounding fee is the authority's charge, not duty, and doesn't make a non-compoundable deviation lawful.

Registration

Registration is not required.

Notarisation

Not required, unless the authority asks for an affidavit.

Witnesses

Not required. The owner's and the professional's signatures suffice.
