LEGAL BASIS

Under section 52 of the Transfer of Property Act, 1882, a transfer made while a suit is pending in which the right to the property is directly and specifically in question does not affect the rights of the parties under the decree, which is why a buyer searches for such suits. In Punjab a registered lis pendens is the only litigation a Non-Encumbrance Certificate will show, so use the property-under-litigation search on rcms.punjab.gov.in as well; neither is a search of the courts' own records. Chandigarh has no notified Non-Encumbrance Certificate service.
