When you need it

The couple's own application to have a marriage solemnised by Anand Karaj entered on the marriage register and a marriage certificate issued. Both of you sign it, with two witnesses to the marriage. Use it when you are both Sikhs, the Anand Karaj has been performed, and you want the marriage registered under the Anand Marriage Act, 1909, which now provides for registration of Anand marriages under rules made by the State government.

The marriage is not invalid because it is unregistered, but the certificate is the paper that banks, passport offices, embassies and courts ask for. The office, the form it wants filled and the supporting papers are fixed by the rules in force, and this application is only your own covering application: if the office insists on its printed form, fill that form and attach this as the covering application. Not for a marriage registered under the general Punjab or Chandigarh marriage registration scheme: use the Marriage Registration Application in this library for that. Not for a civil marriage: that goes through the Marriage Officer.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

This is an administrative application, not an instrument chargeable with stamp duty. A fee may be payable under the rules in force, and a late fee where the application comes long after the marriage; no figure is stated here. Confirm the current fee at the office before applying.

Registration

This application is how the marriage is entered on the marriage register. The certificate the office issues afterwards is the paper other authorities ask to see, not this application.

Notarisation

The application itself is not notarised. The office may ask for a supporting affidavit of the date of the marriage or of either party's status before it; that is sworn before a Notary or an Oath Commissioner. Ask what the office wants before the appointment.

Witnesses

Two witnesses to the Anand Karaj are named and asked to sign. Whether they must come to the office is for the office to say; practice differs by office.
