When you need it

The notice that starts a civil ("court") marriage. Two people who want to marry under the Special Marriage Act, 1954, whatever their religions, begin by giving the Marriage Officer a written notice of their intention. Both sign it.

The Marriage Officer of a district where at least one of you has lived for the thirty days just before the notice is the one to give it to. The notice is then published, the law allows thirty days for any objection, and the marriage can be solemnised after that. The Act prescribes a form of notice. This is your own notice with the particulars the Act asks for, and the Marriage Officer may require you to sign the prescribed form as well; if so, sign that form and keep this as a copy of what you told the office. Each party also commonly gives an affidavit with the notice: use the Court Marriage Affidavit in this library, one for each of you. Not for a marriage that has already taken place, which is registered with the Marriage Registration Application. Not for a Sikh Anand Karaj, a Hindu or a Muslim ceremony: those are solemnised and registered under their own routes.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

This is a notice to a public officer, not an instrument chargeable with stamp duty. The Marriage Officer charges a fee fixed under the Act and the rules; no figure is stated here. Confirm the current fee at the office.

Registration

Not registrable. The notice is kept on the Marriage Officer's file. When the marriage is solemnised, the Marriage Officer enters it in the Marriage Certificate Book, so a separate registration is not needed.

Notarisation

The notice itself is signed before the Marriage Officer or handed in signed, as the office directs. The affidavits that go with it are sworn before a Notary or an Oath Commissioner; carry original photo ID.

Witnesses

No witness signs the notice. Three witnesses sign at the marriage itself, before the Marriage Officer.
