When you need it

The couple's own application to the office that registered the marriage, asking it to correct a mistake in the certificate and in the marriage register: a misspelt name, a wrong date of birth or date of marriage, a wrong parent's name, a wrong address. You both sign it, and attach the papers that show the right entry.

Passport offices, banks, embassies and courts compare the certificate with your other papers, and one wrong letter can hold up a visa or a name change. The office decides whether it can correct the entry itself on an application and supporting documents, or wants an affidavit, or, for a larger change, an order of a court. This application says exactly what the certificate shows, what it should show, and why the entry is wrong, so that the office can decide without going back and forth. Not for registering a marriage that was never registered: use the Marriage Registration Application. Not for a change of name after marriage: use the Name Change After Marriage Affidavit. Not for a mistake in a different paper, such as a birth certificate or a passport.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

This is an application to an office, not an instrument chargeable with stamp duty. The office may charge a fee for a correction; no figure is stated here. Confirm the current fee with the office.

Registration

Not registrable. If the office accepts the correction, it amends the entry in the marriage register and issues a corrected certificate; ask whether the old certificate must be returned.

Notarisation

The application is not notarised. The office may ask for an affidavit from each spouse that the correction is true; that is sworn before a Notary or an Oath Commissioner. Ask what the office wants.

Witnesses

No attesting witness signs the application. The office may ask the original witnesses to the marriage to confirm the correct particulars.
