When you need it

Use this when your written agreement contains an arbitration clause, a dispute has arisen under it, and you want it decided by an arbitrator and not in court. The notice quotes the clause, describes the dispute and your claim, states the place of arbitration, asks the other side to agree to an arbitrator or follow the clause's way of choosing one, and starts the arbitration clock.

It is the step that has to come before any application to a court for the appointment of an arbitrator. Not the application to the High Court to appoint an arbitrator, or a petition for interim relief; those are court papers filed through an advocate. Not for an agreement with no arbitration clause — use the Legal Notice (General Purpose). Not a reply to an arbitration notice — use Reply to Legal Notice (General). Read before sending: copy the clause exactly as it stands in the agreement, because the arbitrator's powers and the way one is chosen come from it. Have an advocate check any named arbitrator for independence before you propose one.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty in Punjab or Chandigarh — a notice that demands payment, performance or the stopping of an act creates, transfers or ends no right in property, and is not a chargeable instrument under the Indian Stamp Act, 1899. Plain paper or an advocate's letterhead is enough; no e-stamp exists for a document of this kind. The agreement that contains the arbitration clause must itself be duly stamped before an arbitrator or court can rely on it; check that separately.

Registration

Not registrable in Punjab or Chandigarh — Section 17 of the Registration Act, 1908 reaches instruments that create or transfer an interest in property, not a one-sided demand. No Sub-Registrar takes a document of this kind.

Notarisation

Not required in Punjab or Chandigarh — notarising the notice adds nothing to its effect. What matters is proof that it reached the Recipient: the registered-post receipt and acknowledgement card, courier tracking, or a signed acknowledgement of hand delivery. Keep these with the file.

Witnesses

None required in Punjab or Chandigarh — this is a one-sided notice, not an instrument two parties sign. Witnesses matter only if the notice is delivered by hand (get the receiver's name, signature and date) or affixed because the Recipient cannot be found (two independent witnesses, a note of where and when, and photographs).

SUBJECT: Notice invoking arbitration under the Supply Agreement dated 4 March 2026

Dear Sir / Madam,

1. THE AGREEMENT AND THE ARBITRATION CLAUSE

1.1 The Sender and the Recipient are parties to the Supply Agreement dated 4 March 2026 (the Agreement). Clause 18 of the Agreement provides for arbitration of disputes between them. It reads:

Any dispute arising out of or in connection with this Agreement shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 by a sole arbitrator appointed by mutual consent.

1.2 The seat, or place, of arbitration is Chandigarh.

1.3 The steps the Agreement requires before arbitration have been taken: A meeting of the parties was held on 10 July 2026 and failed; the Sender wrote on 20 July 2026 and received no reply.

2. THE DISPUTE

2.1 Under clause 6 the Recipient was to pay the second instalment of Rs 8,00,000 by 30 May 2026 against delivery of the goods, which was made on 15 May 2026. The Recipient has not paid and has not given a reason.

2.2 This dispute falls within the arbitration clause of the Agreement.

3. THE SENDER'S CLAIM

3.1 The Sender's claim in the arbitration is: payment of the second instalment of Rs 8,00,000, interest on it from 30 May 2026, and the costs of the arbitration

3.2 The Sender presently claims ₹8,00,000 (Rupees Eight Lakh only), together with interest and costs, and reserves the right to revise the claim and to make further claims in the arbitration.

4. REQUEST FOR REFERENCE TO ARBITRATION AND APPOINTMENT

4.1 The Sender requests that the dispute be referred to arbitration under the Agreement. Under Section 21 of the Arbitration and Conciliation Act, 1996, arbitral proceedings begin on the date this request is received by the Recipient.

4.2 The clause provides for a sole arbitrator to be agreed by the parties, and the Sender asks the Recipient to agree to the appointment of a sole arbitrator.

4.3 The Sender proposes Justice (Retd.) R. K. Sharma, former Judge of the Punjab and Haryana High Court, whose details are given in this notice, as arbitrator. The Recipient is asked to agree or to give reasons for objecting.

4.4 The Recipient is asked to reply in writing within 30 days of receipt of this notice, agreeing to the appointment, or making its own proposal in line with the Agreement. If the parties do not agree on the appointment within the time allowed by the Agreement and the Act, the Sender will apply to the court that has power to appoint the arbitrator.
