When you need it

Use this when you own a property together with a brother, sister, cousin, parent or other co-owner, you want your share separated, and they will not agree or will not discuss it. The notice sets out how the property is held, states your share, asks for a partition by metes and bounds, invites a meeting, and warns that you will sue for partition.

It asks the other side not to sell or build in the meantime. Not the Partition Deed itself, which the family signs once it agrees — see the Partition Deed or the Mutual Partition Agreement Between Co-Owners. Not the suit — see the Partition Suit Plaint, which is filed through an advocate. For farmland held in a revenue holding, see the Application for Partition (Taqseem) of a Joint Holding, which goes to the revenue officer. Read before sending: the share each person gets depends on how the property came to the family and on the law that applies to them, so check the share you state.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty in Punjab or Chandigarh — a notice that demands payment, performance or the stopping of an act creates, transfers or ends no right in property, and is not a chargeable instrument under the Indian Stamp Act, 1899. Plain paper or an advocate's letterhead is enough; no e-stamp exists for a document of this kind.

Registration

Not registrable in Punjab or Chandigarh — Section 17 of the Registration Act, 1908 reaches instruments that create or transfer an interest in property, not a one-sided demand. No Sub-Registrar takes a document of this kind.

Notarisation

Not required in Punjab or Chandigarh — notarising the notice adds nothing to its effect. What matters is proof that it reached the Recipient: the registered-post receipt and acknowledgement card, courier tracking, or a signed acknowledgement of hand delivery. Keep these with the file.

Witnesses

None required in Punjab or Chandigarh — this is a one-sided notice, not an instrument two parties sign. Witnesses matter only if the notice is delivered by hand (get the receiver's name, signature and date) or affixed because the Recipient cannot be found (two independent witnesses, a note of where and when, and photographs).

SUBJECT: Notice calling for partition of House No. 12, Phase 3B1, Mohali, measuring 250 square yards

Dear Sir / Madam,

1. THE JOINT PROPERTY

1.1 The Sender and the Recipient hold House No. 12, Phase 3B1, Mohali, measuring 250 square yards (the Property) jointly, without it having been divided by metes and bounds.

1.2 The Property was owned by the late Shri Balbir Singh, who died on 4 March 2024 leaving no will. It came to the Sender and the Recipient, as his sons, in equal shares, and the mutation was sanctioned in both their names on 18 June 2024.

2. THE SENDER'S SHARE AND REQUEST FOR PARTITION

2.1 The Sender is entitled to one-half undivided share of the Property. The Sender no longer wishes to hold the Property jointly and asks that it be partitioned and the Sender's share separated and handed over.

2.2 The Recipient has been collecting the rent of Rs 25,000 a month from the ground-floor tenant since April 2024 and has not shared it with the Sender.

3. THE DEMAND

3.1 The Sender calls upon the Recipient, within 30 days of receipt of this notice, to agree to a partition of the Property by metes and bounds according to the shares of the parties, and to sign a partition deed for that purpose.

3.2 The Sender proposes the following: The Sender proposes that the ground floor and the front lawn go to the Sender and the first floor and the back portion to the Recipient, with the difference in value settled in cash.

3.3 The Sender is willing to meet the Recipient, and any other co-owner, within that time to settle how the Property is to be divided, with a mutual elder, a surveyor or a valuer present if the Recipient wishes.

3.4 Until the partition is made, the Recipient is called upon not to sell, mortgage, lease or otherwise part with the Property or any part of it, and not to raise any construction on it, without the written consent of the Sender.

4. IF THE RECIPIENT DOES NOT AGREE

4.1 If the Recipient does not agree within that time, the Sender will file a civil suit for partition and separate possession of the Sender's share, together with a claim for the Sender's share of any income taken from the Property, and for costs, as the Sender is advised.

4.2 Nothing in this notice waives any right or remedy of the Sender.

5. SERVICE OF THIS NOTICE

5.1 This notice is served by registered post with acknowledgement due. A notice properly addressed, pre-paid and posted is presumed to have been served in the ordinary course of post (Section 27, General Clauses Act, 1897). Refusal to accept delivery will be treated as service.
