कब ज़रूरत पड़ती है

You are an NRI or OCI cardholder buying residential or commercial property in Punjab or Chandigarh, and want (or the Sub-Registrar/bank asks for) a sworn declaration confirming your status, that the property is not agricultural land, plantation property or a farmhouse — which FEMA does not permit an NRI or OCI cardholder to acquire — and that payment is being made through permitted banking channels. Not for buying agricultural land, plantation property or a farmhouse — the Foreign Exchange Management Act, 1999 and the rules made under it do not permit an NRI or OCI cardholder to acquire these categories by purchase, and this declaration cannot be used to get around that restriction.

I, Aman Deep Singh, S/o Sh. Kartar Singh, presently residing at 17 Elizabeth Street, Sydney NSW 2000, Australia, being a Non-Resident Indian (a citizen of India resident outside India), holding passport number N3456789 and OCI Card No. AUS1234567, PAN ABCDE1234F, do hereby solemnly affirm and declare as under:

1. That I am purchasing residential property described as: Flat No. 402, Tower B, Sunny Enclave, Mohali, from Rakesh Verma ("the Seller"), for a total consideration of ₹65,00,000 (Rupees Sixty Five Lakh only).

2. That the property described above is NOT agricultural land, plantation property or a farmhouse, and that I am aware that the Foreign Exchange Management Act, 1999 and the rules made under it do not permit me, in my capacity stated above, to acquire any such property by purchase.

3. That the consideration for this purchase is being paid through funds held in my NRE account, specifically NRE Account No. XXXXXXXX5678, ICICI Bank, Mohali, and not otherwise than through banking channels permitted for a person of my status.

4. That I undertake to comply with the Foreign Exchange Management Act, 1999 and the rules and regulations made under it, as applicable to acquisition of immovable property in India by a person resident outside India, in all respects concerning this purchase.

5. That the contents of this declaration are true and correct to my knowledge and belief, that no part of it is false and that nothing material has been concealed therefrom.
