When you need it

Use this when a rented home has been sold and the tenant is staying. It tells the tenant, in writing, that the home has changed hands, who the new owner is, from what date rent is payable to the new owner, where to pay, and what is happening to the security deposit.

Both the former landlord and the new owner sign, so that the tenant can see the change is genuine and does not pay the wrong person. The tenancy normally carries on with the new owner on the same terms; a sale does not by itself end it. The two points a sale most often leaves unclear are the rent already paid to the old landlord and the security deposit, so this notice asks you to state both. A tenant who is never told may go on paying the old landlord. Send it as soon as the sale deed is signed, with a copy of the registered sale deed so the tenant can check. Keep proof of how it was sent. Which of Punjab's two rent laws, the Punjab Rent Act, 1995 or the East Punjab Urban Rent Restriction Act, 1949, applies to the tenancy depends on the date of the letting and the building; this notice does not state it, and the new owner should confirm it with a lawyer. Not for: a shop, office or other business premises (use the Tenant Attornment Letter); an assignment of rent between seller and buyer of a business property (use the Rent Assignment Letter to New Buyer); asking the tenant to leave (use the Notice to Quit).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty is payable on a notice or letter of this kind: it creates or transfers no right. The cost is only the postage or courier charge.

Registration

Not registrable: a notice or letter is not an instrument the Registration Act, 1908 requires to be registered.

Notarisation

Not required. What matters is proof that it was sent and received: keep the postal receipt and tracking record, or a signed acknowledgement of delivery.

Witnesses

No witness is needed; the sender signs alone. A witness to a hand delivery is useful if delivery may later be disputed.
