When you need it

Use this when you are a landlord who wants a higher rent and the tenancy agreement has no clause that lets the rent go up. Without such a clause you cannot simply announce a new figure: during the term the rent is what the agreement says unless the tenant agrees to change it, and a rent Act may limit what you can ask.

This notice therefore asks for the tenant's agreement. It states the present rent, the rent you propose and from when, gives the tenant a time to reply, and carries a reply slip the tenant can sign to agree or decline. If the tenant agrees, the signed slip is a written record of the new rent, and you can also sign a Rent Revision Addendum. If the tenant does not agree, the rent stays where it is. Nothing in this notice ends the tenancy, and a refusal is not a ground to throw the tenant out. Punjab runs two rent laws, the Punjab Rent Act, 1995 and the East Punjab Urban Rent Restriction Act, 1949, split by the date of the letting. Each has its own way of dealing with increases and with fair rent, and which one covers your tenancy is for a lawyer to confirm. The notice records which one you understand to apply and does not state it as fact. Not for: an increase the agreement already provides for (use the Rent Escalation Letter); a signed change both sides agree on the spot (use the Rent Revision Addendum); a tenant you want to remove (use the Notice to Quit).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty on the notice itself. A tenant’s signed reply that only agrees the new rent is ordinarily kept with the tenancy papers. If the original agreement was stamped or registered, ask the Sub-Registrar whether a written change of rent needs its own stamp.

Registration

Not registrable: a notice or letter is not an instrument the Registration Act, 1908 requires to be registered.

Notarisation

Not required. What matters is proof that it was sent and received: keep the postal receipt and tracking record, or a signed acknowledgement of delivery.

Witnesses

No witness is needed; the sender signs alone. A witness to a hand delivery is useful if delivery may later be disputed.

RENT INCREASE NOTICE

Date: 2 April 2026

By: Registered post

To: Aarav Sharma, Flat 804, Maya Garden City, Zirakpur, Punjab

From: Harpreet Singh, House No. 45, Sector 21-C, Chandigarh

Subject: request to revise the rent of the home at Flat 804, Maya Garden City, Zirakpur, Punjab

  1. 1. You have been my tenant at the home at Flat 804, Maya Garden City, Zirakpur, Punjab since 1 April 2026. The rent now is ₹25,000 (Rupees Twenty Five Thousand only) a month.
  1. 2. Our tenancy agreement has no clause that lets the rent be raised by notice. I therefore cannot raise it on my own, and I ask for your agreement.
  1. 3. I propose a rent of ₹27,500 (Rupees Twenty Seven Thousand Five Hundred only) a month from 3 April 2026. The reason is: rising maintenance and property tax costs, and rents in the same sector.
  1. 4. Please tell me your decision in writing within 30 days of receiving this notice, by signing the reply slip below and returning it to me.
  1. 5. If you agree, the new rent applies from the date above and every other term of the tenancy stays as it is. Your signed slip, kept with this notice, is the written record of the change, and we may also sign a formal Rent Revision Addendum.
  1. 6. If you do not agree, the rent stays at the present figure. I may then ask the court or authority that decides rent matters to fix a fair rent where the law gives me that right, under the law that governs this tenancy, which I understand to be the Punjab Rent Act, 1995, or decide about any renewal when the term ends. This notice does not end the tenancy.
  1. 7. Until the new rent is agreed, please keep paying the present rent as usual.
