Why you need it

When you need it

For a three-year residential letting with terms settled — not an eleven-month form repeated informally: s.17(1)(d), Registration Act 1908 makes a lease over a year compulsorily registrable, presented within 4 months (s.23). Covers property, term, rent, deposit, repairs, subletting, lock-in and handover coherently. Punjab's rent-control track depends on the letting date/NRI position; Chandigarh runs under the East Punjab Urban Rent Restriction Act, 1949.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Article 35, Schedule I-A, Stamp Act 1899: Punjab 3.25% of average annual rent (fixed-rent, no premium, under 20yrs); Chandigarh 5% of consideration. Stamp before/at execution; cost-sharing doesn’t change legal liability.

Registration

Compulsory — term exceeds a year, so s.17(1)(d), Registration Act 1908 applies. Present within 4 months (s.23); s.25 allows 4 more on fine. An unregistered instrument that should've been registered can't serve as the lease.

Notarisation

Not a substitute for registration — unneeded once registered, unless a specific filing asks for it.

Witnesses

Two witnesses attest execution — Chandigarh expressly requires two-witness verification. Give full details and attend as the office requires.
