When you need it

Use this when you give someone a flat, a house or a floor to live in on permission, for a fixed period of less than a year, and you want the paper to be a licence and not a tenancy. The licensor stays in legal possession and the licensee gets no interest in the property.

A licence is judged on what the parties actually do, not on its name. If the occupant is in fact given exclusive possession and pays rent, a court or the Rent Controller can treat the arrangement as a tenancy, and a rent Act can then apply. Punjab runs two rent laws, the Punjab Rent Act, 1995 and the East Punjab Urban Rent Restriction Act, 1949, split by the date of letting and the kind of building; which of them, if either, reaches your arrangement is a question to settle with a lawyer before you rely on the word licence. Not for: a shop or office (use the Office Leave and Licence Agreement); an ordinary rent tenancy (use the Residential Rent Agreement, 11 Months); a bed or room in a shared house (use the Paying Guest Agreement). The library also carries a general Leave and Licence Agreement that is not written for Punjab and Chandigarh; this one is.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Stamp duty depends on the rent, the term and the deposit, and Punjab and Chandigarh charge differently. As published by the two Revenue Departments and read on 6 September 2026: Punjab charges 4% of the annual rent on a lease or licence of less than one year; Chandigarh has no separate slab for that and charges, in its row for a term up to five years, 2% of the annual average rent plus 3% of the refundable security deposit. Neither table is dated, so confirm the figure on the official e-stamping portal or with the Sub-Registrar before you buy the stamp. If the paper is in substance a lease, the lease rate applies whatever it is called. An under-stamped paper cannot be used as evidence until the deficit and penalty are paid.

Registration

Registration is not compulsory for a term of less than one year with the rent reserved monthly (section 17(1)(d), Registration Act, 1908), which is why such papers are kept short. A Punjab tenancy that falls under the Punjab Rent Act, 1995 may need a written, registered agreement in the form that Act prescribes; check this before relying on a short unregistered paper. If you do register, present the document to the Sub-Registrar within four months of signing.

Notarisation

Not required by law, and not a substitute for stamping or registration. A notary only records that the signatories appeared and signed, which makes it harder to deny a signature later. Carry original photo ID.

Witnesses

Two witnesses are sensible: for a registered document both parties come to the Sub-Registrar with two identifying witnesses who carry original photo ID. Each witness writes full name, address and ID reference beside the signature. A witness is an adult who is not a party to the document.

RESIDENTIAL LEAVE AND LICENCE AGREEMENT

This Leave and Licence Agreement is made at Chandigarh on 1 April 2026.

BETWEEN

Harpreet Singh, of House No. 45, Sector 21-C, Chandigarh (the "Licensor");

AND

Aarav Sharma, of Village Bahadurgarh, Tehsil Patiala, Punjab, who has shown driving licence, number ending 4521 (the "Licensee").

1. The licence

1.1 The Licensor gives the Licensee leave and licence, that is permission, to occupy the flat at Flat 804, Maya Garden City, Zirakpur, Punjab (the "Premises") only as a residence for the Licensee and his wife Simran Sharma and one minor child.
1.2 This is a licence and not a lease. It gives the Licensee no interest in the Premises. The Licensor remains in legal possession and control of the Premises, and the Licensee occupies only as a licensee.
1.3 The Licensor or a person sent by the Licensor may enter the Premises at reasonable hours on twenty-four hours’ notice to inspect them, and at any time in an emergency.
1.4 The Licensor hands over these fittings and furniture with the Premises, to be returned in the same condition apart from ordinary wear: 2 fans, 1 geyser, modular kitchen, 1 double bed.

2. Period

2.1 The licence begins on 2 April 2026 and ends on 1 March 2027, unless it is ended earlier under clause 7.
2.2 The licence ends on that date without any notice. It does not renew by itself or by the Licensee staying on. A further licence needs a fresh written agreement signed by both Parties.

3. Licence fee and charges

3.1 The Licensee pays the Licensor a licence fee of ₹30,000 (Rupees Thirty Thousand only) a month, in advance, by day 5 of each month.
3.2 Payment is made by bank transfer or cheque, and the Licensor gives a written receipt for each payment.
3.3 The Licensee pays the bills for electricity, water, gas, internet and telephone used at the Premises. Society or association maintenance is paid by the Licensor.

4. Security deposit

4.1 The Licensee has paid the Licensor ₹60,000 (Rupees Sixty Thousand only) as a refundable security deposit. It carries no interest.
4.2 The Licensor returns the deposit within 15 days after the Licensee hands back the Premises and the keys. The Licensor may deduct only unpaid licence fee, unpaid bills, and the cost of repairing damage beyond ordinary wear, and must show the Licensee the figures.
4.3 The Licensee may not treat the deposit as the licence fee for any month unless the Licensor agrees in writing.

5. How the Premises may be used

5.1 The Licensee uses the Premises only as a residence, keeps them clean and in good condition, and follows the rules of the society or association, if any.
5.2 The Licensee may not give, share, sub-licence or transfer the Premises or any part of them to anyone else, may not carry on any business there, and may not cause nuisance to neighbours or do anything unlawful.
5.3 The Licensee makes no structural change or alteration without the Licensor’s written consent.
5.4 The Licensor carries out structural and major repairs. The Licensee carries out minor day-to-day repairs, and pays for damage caused by the Licensee or those staying with the Licensee.
