When you need it

Use this when you rent out a flat, a house or a room to a guest for a few days or weeks, whether you find guests through an app or by word of mouth. It records the dates and times, the charge and any advance and damage deposit, the cancellation terms, the guest's ID, and the house rules, and it makes clear that the guest is staying with permission for a short time and is not becoming a tenant.

The stay is limited to a short period on purpose: the form refuses a stay of a month or more. A guest who stays for months and pays a monthly sum is closer to a tenant, and for that you should use the Residential Leave and Licence Agreement or the Residential Rent Agreement, 11 Months. Punjab runs two rent laws, the Punjab Rent Act, 1995 and the East Punjab Urban Rent Restriction Act, 1949, split by the date of the letting, and this document does not say which, if either, could reach a long stay. Take a government photo ID for every adult guest. Foreign guests have to be reported as the law requires; ask the local police or an advocate how, because this document names no form. If you let out a flat in a society, check its rules and any local permission for short stays before you advertise. Not for: a monthly paying-guest arrangement (use the Paying Guest Agreement); a bed in a shared room (use the Bed Space Licence Agreement); a hotel or guest house business (use the Hotel or Guest House Lease).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A plain agreement for a short stay of a few days or weeks, which gives permission to stay and creates no tenancy, is not ordinarily stamped. If the stay grows into a longer arrangement at a monthly sum, record it in a rent or licence agreement and stamp that. If in doubt, ask the Sub-Registrar of the tehsil or check the e-stamping portal. Both parties should keep a signed copy.

Registration

Not required for a short stay; a permission to stay for days or weeks is not a lease that the Registration Act, 1908 requires to be registered.

Notarisation

Not required. A signed copy, the booking record and a copy of the guest’s ID are the useful evidence.

Witnesses

Not required for a short stay. The Host and the Guest sign.

SHORT-STAY GUEST AGREEMENT AND HOUSE RULES

This Agreement is made at Chandigarh on 1 April 2026 between Harpreet Singh (the "Host") and Rohan Mehta, of Flat 12, Andheri West, Mumbai (the "Guest"), who has shown driving licence, number ending 4521.

1. Permission to stay

1.1 The Host allows the Guest to stay in the whole flat at Flat 804, Maya Garden City, Zirakpur, Punjab (the "Premises") from check-in on 2 April 2026, from 2:00 pm, until check-out on 1 May 2026, by 11:00 am, for 3 guests in all.
1.2 This is permission to stay for a short time. It is not a tenancy, and the Guest gets no right to remain after check-out.
1.3 The Guest shows a valid government photo ID for every adult who will stay. The Host may refuse entry to anyone who does not. The Host keeps the ID details safely and gives them to the police only where the law requires.

2. Charges

2.1 The charge for the whole stay is ₹12,000 (Rupees Twelve Thousand only). It is payable in full on or before check-in, and ₹3,000 (Rupees Three Thousand only) has been paid in advance.
2.2 The Guest has also paid a refundable damage deposit of ₹5,000 (Rupees Five Thousand only). The Host returns it within 7 days after check-out, less only the cost of loss or damage beyond ordinary wear, and shows the Guest the figures.

3. Cancellation

3.1 If the Guest cancels more than 3 days before check-in, the Host returns any advance in full. If the Guest cancels later, or does not arrive, the Host may keep from the advance only the loss actually suffered, up to the amount of the advance.

4. House rules

4.1 Only the guests counted in clause 1.1 may stay overnight. Visitors need the Host’s prior permission.
4.2 Quiet hours are 10:00 pm to 7:00 am. The Guest respects the neighbours and the rules of the society or building.
4.3 Smoking: Smoking is not allowed anywhere in the Premises.
4.4 Pets: Pets are not allowed.
4.5 No parties, events or commercial filming without the Host’s written permission, and nothing unlawful may be done or kept in the Premises.
4.6 The Guest looks after the Premises and their fittings, does not copy the keys, tells the Host at once of any damage or fault, and pays for loss or damage beyond ordinary wear caused by the Guest or the Guest’s visitors.
4.7 Other rules: Shoes off inside. Switch off the geyser and lights when leaving. Garbage goes in the bins at the gate.

5. Check-out and ending the stay

5.1 The Guest leaves the Premises clean and tidy and hands back the keys by the check-out time. If the Guest stays beyond it, the Guest pays a reasonable charge for the extra time.
5.2 If the Guest seriously breaks the house rules or puts others at risk, the Host may end the stay at once by telling the Guest. The Guest then leaves at once, and the Host returns the charge for the unused nights, less any loss caused.
5.3 The Host may enter the Premises in an emergency, or after telling the Guest, to carry out urgent repairs.
