When you need it

This is the tenant's court paper. You have been served with a summons and an eviction petition from the Rent Controller, and you want to contest it. The paper does two things in one: it asks the court's permission to contest, and it gives your written reply to the petition.

Why it matters: in a summary petition, such as one by a landlord with a special right to quick possession, the tenant's right to defend can depend on applying for leave to contest within a short time of the summons, and a tenant who does not apply may find the landlord's facts taken as admitted. The time allowed is short and fixed by the Act and by the summons itself. Read the summons for the date, and do not rely on any number of days written here. In an ordinary contested petition the same paper serves as your reply. Punjab has two rent laws, the Punjab Rent Act, 1995 and the East Punjab Urban Rent Restriction Act, 1949, split by the date of the letting; the form of the proceeding, the section for leave to contest and the time limit can differ between them. Which one governs your case is for you and your advocate to confirm. Not for: a reply to a landlord's notice before any case is filed (use the Tenant Reply to an Eviction Notice). Court papers like this are usually filed through an advocate, who signs below and files a vakalatnama. Court fee is paid at filing; the amount is set by the court office, so ask the counter or your advocate, because it is not stated here.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

This paper is not an instrument under the Stamp Act: it bears court fee, not stamp duty. The court fee on an application and reply in a Rent Controller’s court is not stated here; ask the filing counter of the court or your advocate, in Punjab and in Chandigarh. The affidavit carries a small fixed stamp, which the stamp vendor or the e-stamping portal will tell you. The vakalatnama carries its own court-fee and welfare stamps.

Registration

Nothing here is registrable: it is filed in court. If you hold a written rent agreement or rent receipts, file copies and keep the originals ready for the hearing.

Notarisation

The application and reply are not notarised. The affidavit must be sworn before an Oath Commissioner or a Notary; carry original photo ID.

Witnesses

No attesting witnesses. The Respondent signs the application, the reply, the verification and the affidavit, and the advocate signs below. Witnesses to the facts, such as neighbours or the person who took rent, give evidence at the hearing.

IN THE COURT OF THE RENT CONTROLLER, Chandigarh

Rent Petition No. 215 of 2026

Harpreet Singh ... PETITIONER (LANDLORD)

VERSUS

Aarav Sharma, of Flat 804, Maya Garden City, Zirakpur, Punjab ... RESPONDENT (TENANT)

APPLICATION FOR LEAVE TO CONTEST THE PETITION, WITH THE RESPONDENT’S REPLY

RESPECTFULLY SHOWETH:

  1. 1. THE TENANCY. That the Respondent is the tenant of the premises at Flat 804, Maya Garden City, Zirakpur, Punjab (the "premises") since 1 April 2026, at a rent of ₹30,000 (Rupees Thirty Thousand only) a month. The Petitioner has brought the petition under section 13-B.
  1. 2. TIME. That the summons was received by the Respondent on 2 April 2026. This application is made within the time the law allows. If this Court finds that any day has been lost, the Respondent asks that it be condoned for the reasons stated in the affidavit.
  1. 3. RENT. That the Respondent has paid the rent as follows: Rent has been paid every month by bank transfer up to August 2026, and receipts are held.. The Respondent has always been ready and willing to pay the rent.
  1. 4. FACTS THAT NEED A TRIAL. That the Respondent states these facts, which, if proved, would defeat the petition: The petitioner is not a non-resident Indian and has not owned the home for the period he claims; he lives in the same town.. These are disputed facts and cannot be decided without evidence. The Respondent therefore asks for leave to contest.
  1. 5. REPLY TO THE PETITION. That every statement in the petition is denied, except what is expressly admitted in this reply. The Respondent does not admit the Petitioner’s title, status or need as pleaded, and puts the Petitioner to strict proof.
  1. 6. THE PETITIONER’S NEED IS DENIED. That the Respondent denies that the Petitioner needs the premises, for these reasons: The landlord owns another vacant house in Sector 44, Chandigarh, which is suitable for his family..
  1. 7. OTHER DEFENCES. That the Respondent also relies on these defences: The petition names the wrong premises and does not join the co-owner..
  1. 8. DOCUMENTS. That the Respondent files these papers with this reply: rent agreement dated 1 April 2024; bank statement; rent receipts.
  1. 9. RENT TO CONTINUE. That the Respondent will keep paying the rent as it falls due and, if this Court so directs, will deposit it in Court.

PRAYER

The Respondent prays that this Court may be pleased to: (a) grant the Respondent leave to contest the petition; (b) take this reply on the record and fix the case for evidence; (c) dismiss the petition with costs; and (d) grant any other relief that this Court thinks fit.
