When you need it

A vehicle is being given, between family members, as a genuine gift — no sale price, no consideration of any kind — and you need a document recording that gift to support transfer of its Registration Certificate into the Donee's name at the RTO on a gift basis, rather than as a sale. Section 122 of the Transfer of Property Act, 1882 defines a gift as a transfer of movable or immovable property made voluntarily and without consideration, and accepted by the donee.

Section 123 then draws the distinction this Affidavit relies on: a gift of immovable property — land or a house — must be made by a registered instrument, but a gift of movable property, which a motor vehicle is, may be made either by a registered instrument or simply by delivery. That is why a vehicle gift needs no registered Gift Deed the way a property gift does; this sworn Affidavit, recording the gift and the Donee's acceptance of it, is what a Registering Authority in Punjab or Chandigarh works from instead. In Punjab the transfer itself is filed with the Sub-Divisional Motor Vehicle Officer or District Transport Officer of the district; in Chandigarh, with the Registering Authority, Union Territory of Chandigarh — the same offices, and the same Form 29 and Form 30, a sale would use, since Section 50 of the Motor Vehicles Act, 1988 governs a change of ownership for any reason, not sale alone. Not for a transfer for consideration, however small or however it is described — that is a sale, and the Car / Bike Sale Agreement, not this Affidavit, is the document, whatever the parties choose to call it; not for a gift of land or a house, which needs a registered Gift Deed, not an affidavit; and not for the general RC Transfer Affidavit some Registering Authorities ask for on a straightforward sale or on succession, which is a shorter, different document from this one.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

An affidavit is chargeable under Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, which Schedule also governs the Union Territory of Chandigarh — the same nominal treatment every affidavit on this site carries, and not the ad valorem duty a Gift under a separate article of the same Schedule would carry on a formal Gift Deed. That distinction holds only because this Affidavit does not itself operate as the instrument effecting the gift: under Section 123 of the Transfer of Property Act, 1882, a gift of movable property is complete on delivery, so nothing here needs to be, or is, a conveyance. If the Donor and Donee instead choose to execute a formal, registered Gift Deed for the Vehicle — unnecessary, but sometimes still done for the added evidentiary weight, or because a bank or insurer specifically asks for one — that different instrument would attract the ad valorem Gift article's duty instead of this Affidavit's nominal one; keep the two apart. This Affidavit is sworn on a non-judicial stamp paper of the smallest denomination generally sold at a treasury, an SHCIL e-stamp counter or an authorised stamp vendor in Punjab or in Chandigarh. Punjab's Schedule 1-A rates for affidavits have been revised by notification from time to time, and the exact current rupee figure was not independently confirmed for this template — confirm it at the stamp vendor on the day of purchase.

Registration

Not registrable under the Registration Act, 1908, in Punjab or in Chandigarh — and, unlike a gift of immovable property, no registration is even needed to make the gift itself effective. Section 123 of the Transfer of Property Act, 1882 requires a gift of immovable property to be made by a registered instrument, but permits a gift of movable property, which a motor vehicle is, to be made either by a registered instrument or simply by delivery. This Affidavit records a gift already made complete by delivery of the Vehicle to the Donee; it goes into the Registering Authority's transfer file with Form 29 and Form 30. "Registration" of the Vehicle itself is the separate Motor Vehicles Act sense of the word — the Registering Authority's own record of ownership, changed under Section 50 of that Act — not the Registration Act, 1908 at all.

Notarisation

The Donor's affidavit is sworn or affirmed before a Notary Public or an Oath Commissioner appointed for Punjab or for the Union Territory of Chandigarh, who verifies the Donor's identity and signs, stamps and dates the affidavit, before it is uploaded or produced with the transfer application. The Donee's acceptance is a plain signature and is not itself sworn.

Witnesses

No statute requires a witness to this Affidavit beyond the notarial attestation of the Donor's oath, in either jurisdiction. Given what is being given away, two witnesses to the Donee's acceptance are good practice, though not legally required.

VEHICLE GIFT AFFIDAVIT

2.1 Out of natural love and affection for Rohit Kumar, my son, and without any consideration in money or money's worth, I hereby gift, transfer and hand over the Vehicle absolutely to Rohit Kumar, of House No. 33, Sector 21-D, Chandigarh 160022 (the "Donee"), to hold as the Donee's own property from the date of this Affidavit.

2.2 Under Section 123 of the Transfer of Property Act, 1882, a gift of movable property may be effected either by a registered instrument or by delivery. This Affidavit records that the gift is made and completed by delivery of the Vehicle, its keys and its documents to the Donee, as confirmed in the Donee's acceptance below.

2.3 I confirm that I am the lawful owner of the Vehicle, with full power to gift it, and that I have received no consideration of any kind, directly or indirectly, for this gift.

  1. 3. HYPOTHECATION

3.1 The Vehicle is free from any hypothecation, loan or charge, and its Registration Certificate shows no financier's name.

  1. 4. DECLARATION

4.1 Every statement made above is true to my own knowledge, information and belief, and I have concealed nothing material to this Affidavit. I am aware that furnishing false information to the Registering Authority is an offence under the Motor Vehicles Act, 1988, and that the transfer sought is liable to be refused, or reopened, if any statement made here is found false.

VERIFICATION

Verified at Chandigarh on 1 April 2026 that the contents of paragraphs 1 to 4 above are true and correct to my own knowledge, that no part of it is false, and that nothing material has been concealed.
